Prevent Unjust Separation: Allow Me to Stay in Australia with My Husband

The issue

 

I am a long-term resident of Australia, having lived here for the past 5 years. This country has become my home. Despite this, the Department of Home Affairs has refused my partner visa application, threatening to separate me from my husband.

I am sharing with you the statement written by  my husband to the Department of Home Affairs which outlines what I have been through in detail. I did not share these details earlier as I was embarrassed but my family and friends encouraged me to share these details and said I don't have to be ashamed as I am not the one who has done the wrong thing, it's other people who have done the wrong thing by me for their personal gains.

Here is the statement written by my Husband:

I am writing this because there are a number of matters that the department should be aware 
of and there is no other avenue for my wife and I to introduce these matters other than by making 
this statement which details the background of the matters we have outlined in our previous 
statements.
2) I have never met anyone in all my 53 years who has shown me the same level of unconditional 
love that my wife Absane demonstrates toward me on a daily basis regardless of my state of mind 
or behavior both good and bad in both her words and deeds. Shortly after frst meeting Absane we 
started communicating via text message and we became unusually comfortable sharing our most 
intimate and personal thoughts and experiences with each other. We began discussing our 
challenges, life experiences and our dreams of how we were going to make our lives better. Once I began discussing abuse with Absane and I realised she has been subject to Absane said 
things to me that clearly demonstrated to me that she was a survivor of sustained and 
extensive abuse. Absane was able to articulate in detail the feelings she had
experienced. She also went into detail about the predatory behavior she experienced by her step�father, including grooming behaviours. I have no doubts of her accounts as she was well able to articulate her experiences 
before I even mention to my own. The intimidation, violence, and the sustained pressure to 
acequias to the sexual demands of her step-father was frightening.
3) Absane and I quickly bonded and developed a deep trust in each other that neither of us had 
ever experienced with anyone else or have found in any other human beings. I feel now is the time 
and having permission from Absane; I would like to go into some detail about our personal 
discussions as we both believe it to be directly relevant to this case. Information discussed is 
more detailed relating to the statement provided to the Department of Home Affairs. 
4) Firstly in relation to how Absane decided to come to Australia and the visa she came on and the 
circumstances leading up to her arriving here.
Absane is the only child to her mother Veena Rani and her deceased father Victor Malik. Her 
parents separated when she was an infant and Absane was told her father was deceased when 
she was 12 Years old by her English teacher in class in front of the other students. The teacher 
discussed this as He was an associate of Victor. It was then up to Absane to inform her mother 
who then was forced to confrm the news from Victor's Family. NB: ( If Victor Malik passed away 
when Absane was 12 Years old, then how did a dead man who had been passed away for 12 Years 
apply for a student loan for Absane from the grave; unless his details were fraudulently provided 
by the same criminals who organized Absane's visa and stated that she was married). In 2017 
Absane's mother remarried without the knowledge of Absane until the day he came home to live 
with them. Absane's mother Veena had no issue legally marrying her new husband being as 
though her original husband was deceased. 
(5) Soon after moving in, Absane's step-father , started to try to molest her on a 
number of occasions. Absane and her mother slept in the marital bed in between her mother and 
step-father. consequently he inserted himself between the mother and daughter while Veena 
slept. Suraj ( step- father) would do his best to force himself upon Absane. He would start with unwanted 
touching and on a number of occasions attempted to force her to have intercourse with him. 
Absane usually manage to avoid the unwanted intercourse. Absane had to go to sleep however 
and one night when her mother was at work, Absane was asleep and woke up to Suraj sucking on her breasts. Absane screamed and ran to another room where she stayed until her mother came 
home. Absane spoke with her mother in-depth about the incident however due to both the sick 
culture and her mother's fear of her husband she gingerly broached the subject with Suraj. He 
became abusive and proceeded to become intoxicated and escalated the abuse. From then on 
every time her mother had a night shift, she ensured to take Absane with her. Suraj became upset 
at the arrangement and questioned Veena as to why Absane had to go to work with her. when 
explained to him very carefully that Absane was doing work experience to improve her nursing 
prospects. The unwelcomed touching continued whenever Suraj had the opportunity which 
Absane tried to avoid as much as possible. Absane had enrolled to read for her Masters Degree in 
Psychiatry in Delhi which meant she could study there away from the predator. Suraj would have 
none of this and forbade Absane from going to Delhi to study as he wanted her at home. 
(6) Absane decided she wanted to pursue a long-term goal and go and work in Australia. Her step�father said that he had a close friend who was an immigration agent. Suraj said he could organize 
the visa for her at a discounted rate. Suraj then told Absane that in order to obtain the visa she 
would have to participate in a medical examination which would require her to prove that she was 
sexually active and no longer a virgin. Suraj said that this was a prerequisite of the Australian 
Government so that she would not be able to marry in Australia as Australian men would not marry 
a non-virgin. This seemed very strange to Absane. Suraj then told Absane that the only way to get 
around this obstacle was for her to have sex with him or she would not get her visa. Absane 
refused to have sex with him at any circumstances. Suraj tried this again when he took Absane out 
to buy food and told her he had alcohol and they could do it there and then and her mother would 
need never know. The next day Suraj Approached her again and told her she had to prove that she 
was sexually active. Absane refused again but he kept on pushing the subject consistently. After a 
few days Suraj then said, if she wouldnt have sex with him then she could have sex with his friend 
the lawyer who was like a family friend and an uncle to Absane. The idea disgusted Absane as it 
felt like she would be having sex with her father. When this ploy did not work Suraj then said if she 
was not prepared to have sex with him or the lawyer then she would have to go to a motel where 
He and the immigration agent had arranged for a number of men to come in and have 
sex with her after they had administered a strong sedative to her whilst he video recorded it for 
evidence for the visa. Under duress Suraj took Absane to the hotel. Absane was shaking so badly 
that she could hardly walk but with the two men watching her she had no choice but to go into the 
room where she sat and shook. Absane refused the drugs as it was a powder and she did not 
know what it was. Absane sat on the bed and waited. Eventually she mustered up the courage to 
leave the room. Finding her way down the stairs which was difcult due to her violent shaking. 
When she reached the bottom of the stairs Suraj and the immigration agent were waiting there for 
her and they yelled at her to get back up in the room as these men had paid already. Suraj said that 
the men were almost at the hotel and they were only few minutes away. Absane freaked out 
pushed passed the 2 men and ran past the front door of the motel which is when she saw the 
name of the motel which was located in Amritsar, Punjab, India. Sometime 
shortly after that incident Suraj said to Absane that if she wouldn't have sex with him then she 
would need to come up with more money for the agent to get around the Australian Law. Nothing 
More was said about being sold to men but the unwanted touching did not slow down. Suraj said " 
its a good thing you didn't have sex with those men because when you left, I went to the office of 
the Immigration Agent and he showed me videos of other girls being raped by several men 
and in every hole and you could not handle it up the ass." Suraj then told Absane that he enjoyed 
the movie so much that the immigration agent let him and some other men do the same thing to 
another girl.
(7) A few days later Suraj and another immigration agent named who worked in the office 
of immigration agent that was Suraj's friend; took Absane to get some photos done for her visa. When they arrived at the frst location, 
Absane was asked to stand next to a stranger for the photo and he put his arm around Absane. 
They went to 2 other separate locations and Absane was made to take more photos with the man 
whom she did not know. When Absane asked who the man was she was told he is going to 
Australia also and they want to take some photos to help with his visa. It was not until Absane was 
in Australia and she applied for a TFN; which is when she got the letter from the ATO which  her name as MRS Malik. Absane rang the immigration agent and they told her that he sorted her 
student visa and a Man was here on a spouse visa and she was his spouse which was 
news to Absane. The immigration agent told her that it was just a favour he did for that man
and she doesnt need to worry about anything. The agent told Absane she didn't have anything to do 
with him and she was free to do whatever she liked as long as she kept her mouth shut. The Agent 
said Absane's silence was a must as he and his friends were very powerful and they could make 
her life very difcult if she didn't play the game. 
(8) Absane asked the immigration agent a short time later for the IMMI Account password and the 
status of her visa so she could se the details for herself. She was warned again and no paperwork 
was forthcoming. 
(9) When Absane arrived in Australia she had no where to go and so she reached out to the 
immigration agent to ask for help. The immigration agent organised for Absane to stay at a room 
above a restaurant on a non-functioning air mattress to be shared with another girl. This 
accommodation Absane was told was to be strictly temporary and she had to be out ASAP. At this 
time, Absane met some lovely people at the Uniting Church in Warrnambool, Victoria. These 
people offered Absane a place to live with food provided for minimal rent. Before arriving in 
Australia the immigration agent told Absane that her course was starting in 6 months time from the time she 
arrived. Absane found work and stayed with the old couple from church until the course started in 
Melbourne. The old couple advised Absane that you should call your college and fnd out more 
about the course and ask them to send you a student handbook. Absane rang The college and spoke with an administration officer  and 
enquired about her course. He advised Absane that the course had already begun and she 
was late. He called Absane to their office. Absane was terrifed that she had done something 
wrong so she rang the immigration agent and explained to him what had occured and he said to her 
that when you get there tell them that I have sent you and it will all be fine. After telling them 
what I had been told to say, everything mysteriously seemed to get fixed immediately. Next day, 
Absane received a revised offer letter from the college without signing any paperwork. The 
administration of the course told me that they did not need my signature as they had a copy. Upon 
completing her course, Absane started working in Melbourne as a Carer/ Nurse for a rehab and care facility which is where she met a resident who she was to care for up 
until his death on April 30, 2022. 
(He was actually my best friend for many years. I used to come and visit him 
regularly from Tassie as his health was deteriorating rapidly and I never knew how long he had left. He was an extremely complex character with many and various physical, mental, emotional, 
and lifestyle challenges. I was visiting him one time around Christmas 2021 and he was worse 
than I had seen him before. He was in nappies, he was grieving the loss of his wife and child who 
died in a car crash overseas. He had lost a lot of weight, he was using a walking frame and he 
was particularly distressed about the lack of function of his body parts. He was a survivor of 
childhood abuse at the hands of his father and he never quite recovered, in fact the older he got 
the worst he got. Basically, he was a mess and when I went back to Tassie and said Goodbye I 
never thought I would see him again. He was estranged from his family as his brother, his 
mother, and his father all had FVO orders on him so he had no family support. This hurt him
greatly and effected his attitude drastically. This meant due to his anger issues he wore out his 
welcome quickly at most facilities. This is one more reason why I visited him regularly. 
(11) In February or March 2021, I remember getting a call from him and he was over the moon. 
He couldn't say enough good things about this carer he had met who was going to be his new full�time carer he said. He seemed really happy and not the suicidal man who was drinking himself to 
death a couple of months beforehand. He even joked about how nice she was to look at even 
if he wasn't able to do anything about it. I was stoked that he had found a decent carer who he 
liked and who liked him. This was so good because he went through carers and facilities like 
undies. 
(12) It was on my next trip to see him that I fnally met Absane, and I thought she was bloody 
gorgeous as well inside and out. We started keeping in contact about my friend's health but even back then 
we both held a secret fame for each other. At the time I was in no physical condition to even think 
about having a partner. During this time, I was given 6-12 months to live and was very confused 
about what to do with myself. I had become closer to Absane but as much as I was secretly in love 
with her, I didn't wanted to jump in anything at the time. So I then embarked on a trip around 
Australia to see all my old friends and family. I was in daily contact with Absane and our feelings 
grew to the point we couldn't deny them any longer. We had just told each other that we care 
deeply for each other and then the next day the terrible news came whilst I was on a holiday 
seeing my friend on the Gold Coast. My friend who Absane was caring for was gone. Absane and I had already been spending a 
lot of time together over the past several months but I couldn't return to Absane due to the fact 
that my deceased friend's mum  was not coping at all with his passing. As a result, Absane stepped up 
when needed and went to nurse her in her time of need. Her condition was extremely serious and 
she was deteriorating at a rate of knots. Absane was on the phone to me often about how 
concerned she was and I suggested she called family of the lady her other son and her EX- husband. When Absane spoke with the lady's family she told them the severity of her condition 
however, both of them said they had too much on to come and see her. When Absane told the lady 
about the phone call she became very upset. Absane rang me the next day to let me know how 
concerned she was about her and we decided all she could do was be there for her. Not long after 
that Absane informed me about the circumstances surrounding the lady's death. Absane told me that 
she was alone with her in the house and the night before she died she was really bad. Absane 
encouraged her to go to hospital but she refused because in her last admission to hospital she 
was treated poorly and was not prepared to put up with that again. That night late at night when 
Absane went in to check on her and they had a great conversation. The lady made it clear to Absane 
how grateful she was to Absane for how she had looked after her son and How she had looked 
after her. The lady said you are like a daughter to me and I consider you my adopted daughter and I 
wish you were my daughter-in-law. She also said to Absane how grateful she was that Absane and 
I were able to pay for her son's funeral as his family weren't prepared to. Absane and I had been 
already been spending a lot of time together over the past several months and she was as 
devastated to loose the friend she was caring for as I was. In our grief and other challenges it was clear that someone 
had to step up and look after his dog  and his deceased mum's dog as the family weren't 
prepared to take them on. So, Absane and I decided to look after them. Not long after the lady passed, 
her puppy dog  got cancer and despite our best efforts and all the treatment we could afford 
we unfortunately had to make the difcult decision to euthanize her and have her cremated. It was 
heart-breaking to see 3 loved members of a family all pass away within a couple of months of 
each other. As a result of these losses all close together as they were, Absane struggled with 
compound grief and severe depression and was not thinking clearly from the time we lost the friend 
and for about 6 months afterwards. Absane agreed to see a grief counsellor which made some 
difference however, counselling was not enough and Absane needed medication for some time. 
Especially, after having to perform CPR on the lady and Absane could not get that image out of her 
head. This alone would have not had the devastating effect it did had Absane received support 
from the other family members. My deceased brother's frst words to Absane when his brother died was 
what's happening with his superannuation as he may need it to pay for the funeral however, when 
it came time to pay for the funeral the brother was not willing to pay anything neither was his father or his 
mother. So, it was left to me and Absane. Before,my friend died he asked Absane to personally take 
care of his funeral and do not under any circumstances was Absane to discuss any of his details or  
personal details at all.

After loosing mum in 2021 
and loosing my dog in the same year and then loosing my friend the next year, Absane and have been 
through enough grief and stress to last a lifetime.
(14) I know I have gone into a lot of detail in this statement however, that is to address directly the 
fallacious accusations made against us by people who have more to hide than we ever will. Even 
though the story is complex, it is my understanding that the main requirements of us to obtain a 
partner visa are that we are together for 12 months which we will provide further evidence to 
prove. The other requirement is that we are legitimate couple which we will provide further 
statements again just to make sure it is clear about the legitimacy of our relationship.


I am not just another number in the immigration system; I am a person who has faced abuse and trauma. Yet, despite these challenges, I have strived to contribute positively to Australian society. I am well-educated and employed full-time. Not once have I relied on government assistance or been a burden on society.

Despite the contributions I have made and my personal circumstances, the Department of Home Affairs is forcing me into an unjust separation from my husband - an act that goes against basic human rights principles as stated by United Nations Human Rights Council (Article 16).

This petition is not just about me; it's about all individuals who face similar situations - those who are being separated from their loved ones due to bureaucratic decisions that do not consider personal circumstances or contributions made by immigrants.

We urge the Department of Home Affairs to reconsider its decision regarding my partner visa application so that I can continue living with my husband in our home here in Australia without fear of separation or deportation.

(He was actually my best friend for many years. I used to come and visit him 
regularly from Tassie as his health was deteriorating rapidly and I never knew how long he had left. He was an extremely complex character with many and various physical, mental, emotional, 
and lifestyle challenges. I was visiting him one time around Christmas 2021 and he was worse 
than I had seen him before. He was in nappies, he was grieving the loss of his wife and child who 
died in a car crash overseas. He had lost a lot of weight, he was using a walking frame and he 
was particularly distressed about the lack of function of his body parts. He was a survivor of 
childhood abuse at the hands of his father and he never quite recovered, in fact the older he got 
the worst he got. Basically, he was a mess and when I went back to Tassie and said Goodbye I 
never thought I would see him again. He was estranged from his family as his brother, his 
mother, and his father all had FVO orders on him so he had no family support. This hurt him
greatly and effected his attitude drastically. This meant due to his anger issues he wore out his 
welcome quickly at most facilities. This is one more reason why I visited him regularly. 
(11) In February or March 2021, I remember getting a call from him and he was over the moon. 
He couldn't say enough good things about this carer he had met who was going to be his new full�time carer he said. He seemed really happy and not the suicidal man who was drinking himself to 
death a couple of months beforehand. He even joked about how nice she was to look at even 
if he wasn't able to do anything about it. I was stoked that he had found a decent carer who he 
liked and who liked him. This was so good because he went through carers and facilities like 
undies. 
(12) It was on my next trip to see him that I fnally met Absane, and I thought she was bloody 
gorgeous as well inside and out. We started keeping in contact about my friend's health but even back then 
we both held a secret fame for each other. At the time I was in no physical condition to even think 
about having a partner. During this time, I was given 6-12 months to live and was very confused 
about what to do with myself. I had become closer to Absane but as much as I was secretly in love 
with her, I didn't wanted to jump in anything at the time. So I then embarked on a trip around 
Australia to see all my old friends and family. I was in daily contact with Absane and our feelings 
grew to the point we couldn't deny them any longer. We had just told each other that we care 
deeply for each other and then the next day the terrible news came whilst I was on a holiday 
seeing my friend on the Gold Coast. My friend who Absane was caring for was gone. Absane and I had already been spending a 
lot of time together over the past several months but I couldn't return to Absane due to the fact 
that my deceased friend's mum  was not coping at all with his passing. As a result, Absane stepped up 
when needed and went to nurse her in her time of need. Her condition was extremely serious and 
she was deteriorating at a rate of knots. Absane was on the phone to me often about how 
concerned she was and I suggested she called family of the lady her other son and her EX- husband. When Absane spoke with the lady's family she told them the severity of her condition 
however, both of them said they had too much on to come and see her. When Absane told the lady 
about the phone call she became very upset. Absane rang me the next day to let me know how 
concerned she was about her and we decided all she could do was be there for her. Not long after 
that Absane informed me about the circumstances surrounding the lady's death. Absane told me that 
she was alone with her in the house and the night before she died she was really bad. Absane 
encouraged her to go to hospital but she refused because in her last admission to hospital she 
was treated poorly and was not prepared to put up with that again. That night late at night when 
Absane went in to check on her and they had a great conversation. The lady made it clear to Absane 
how grateful she was to Absane for how she had looked after her son and How she had looked 
after her. The lady said you are like a daughter to me and I consider you my adopted daughter and I 
wish you were my daughter-in-law. She also said to Absane how grateful she was that Absane and 
I were able to pay for her son's funeral as his family weren't prepared to. Absane and I had been 
already been spending a lot of time together over the past several months and she was as 
devastated to loose the friend she was caring for as I was. In our grief and other challenges it was clear that someone 
had to step up and look after his dog  and his deceased mum's dog as the family weren't 
prepared to take them on. So, Absane and I decided to look after them. Not long after the lady passed, 
her puppy dog  got cancer and despite our best efforts and all the treatment we could afford 
we unfortunately had to make the difcult decision to euthanize her and have her cremated. It was 
heart-breaking to see 3 loved members of a family all pass away within a couple of months of 
each other. As a result of these losses all close together as they were, Absane struggled with 
compound grief and severe depression and was not thinking clearly from the time we lost the friend 
and for about 6 months afterwards. Absane agreed to see a grief counsellor which made some 
difference however, counselling was not enough and Absane needed medication for some time. 
Especially, after having to perform CPR on the lady and Absane could not get that image out of her 
head. This alone would have not had the devastating effect it did had Absane received support 
from the other family members. My deceased brother's frst words to Absane when his brother died was 
what's happening with his superannuation as he may need it to pay for the funeral however, when 
it came time to pay for the funeral the brother was not willing to pay anything neither was his father or his 
mother. So, it was left to me and Absane. Before,my friend died he asked Absane to personally take 
care of his funeral and do not under any circumstances was Absane to discuss any of his details or  
personal details at all.

After loosing mum in 2021 
and loosing my dog in the same year and then loosing my friend the next year, Absane and have been 
through enough grief and stress to last a lifetime.
(14) I know I have gone into a lot of detail in this statement however, that is to address directly the 
fallacious accusations made against us by people who have more to hide than we ever will. Even 
though the story is complex, it is my understanding that the main requirements of us to obtain a 
partner visa are that we are together for 12 months which we will provide further evidence to 
prove. The other requirement is that we are legitimate couple which we will provide further 
statements again just to make sure it is clear about the legitimacy of our relationship.


I am not just another number in the immigration system; I am a person who has faced abuse and trauma. Yet, despite these challenges, I have strived to contribute positively to Australian society. I am well-educated and employed full-time. Not once have I relied on government assistance or been a burden on society.

Despite the contributions I have made and my personal circumstances, the Department of Home Affairs is forcing me into an unjust separation from my husband - an act that goes against basic human rights principles as stated by United Nations Human Rights Council (Article 16).

This petition is not just about me; it's about all individuals who face similar situations - those who are being separated from their loved ones due to bureaucratic decisions that do not consider personal circumstances or contributions made by immigrants.

We urge the Department of Home Affairs to reconsider its decision regarding my partner visa application so that I can continue living with my husband in our home here in Australia without fear of separation or deportation.
