Prevent Texas DSHS from banning Delta 8 and THC isomers

The Issue

Delta 8 THC derived from federally legal industrial hemp is a cannabinoid with many medicinal uses which has been used by thousands of Texans since the 2018 Farm Bill went into effect. 

Texas House Bill 1325 legalized the production, possession, use and transportation of any part of the hemp plant under 0.3% Delta 9 THC. Under this bill and the aforementioned Farm Bill, Delta 8 and all other hemp derived isomers should be considered legal in the state of Texas. 

Texas Department of State Health Services has exceeded its authority as a non legislative and non law enforcement body by overriding the intent of the Texas state legislature and acting as a law making organization, contrary to the constitution of the state of Texas and its own bylaws.

Delta 8 THC is used by thousands of Texans daily to help with a variety of ailments and has allowed many customers to transition from prescription opioids or black market Marijuana. 

By outlawing Delta 8, DSHS is adversely affecting the very Texas consumers it is established to protect. Consumers are now faced with a choice between potentially dangerous and illegal black market products, suffering through their pain, or going back to addictive and dangerous opioids. 

 

We the undersigned call upon the Texas Department of State Health Services, and its Commissioner Dr. John Hellerstedt, to immediately retract their statement on the legally of Delta 8 and THC isomers and to remove any and all claims as to the legal status of such products from the DSHS website.
