Remove State and Federal Officers for violating Oaths of Office

Remove State and Federal Officers for violating Oaths of Office

The Issue

Can A State pass a law opting out of the electoral college. NO
1. This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding. US Cons. Article 6.
2. Under current law any individual elected or appointed to an office of honor or profit in the civil service or uniformed services, except the President, shall take the following oath: “I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter.” (33 U.S.C. § 3331.) By federal statute, all state officers shall take an oath in the simple form first promulgated in 1789. (4 U.S.C. § 101.)
3. 10th Amendment US Cons. - The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Any State officer that attempts to make laws contrary to the US Constitution is in direct violation of the supremacy clause and the oath they took to office. Any infraction of the oath of office necessarily invokes Federal jurisdiction. The mere taking of steps to pass laws that infringe on our Cons. rights or electoral laws in New Mexico is a willingly and knowingly violation of the oaths these officers have taken.

I would urge the citizens of New Mexico to petition the President to urge his justice department to investigate and prosecute the officers of the various states for their intentional violations to their oaths they took, in combination with any other and further actions they seem appropriate. A tree can not grow without branches.
