Read this story about a black Colorado man who was arrested in Colorado for possessing marijuana, while he had an active medical marijuana card. Did medical marijuana rights protect him? Read on to find out. 

• Palisade, Colorado (2015). Dean Richardson (an African-American male) is arrested for possession of marijuana with intent to distribute.
• During the arrest, Richardson presented all his medical marijuana card to Officers.
• The card was confiscated and entered into his "Discovery of Evidence" to be used against him at trial.
• However, during the trial, his marijuana card, nor status was ever discussed or mentioned.
• Richardson subsequently was acquitted of all of other charges but, was found guilty of possessing marijuana illegally, and sent to prison.
• Richardson appealed the decision in Colorado Court of Appeals.
• The Colorado Court of Appeals affirms the decision by suggesting, "Richardson may have been granted an affirmative defense if he had a marijuana card, however he has not demonstrated that he is entitled to a hearing."

Essentially, the court argues that Richardson never gave authorities a medical marijuana card for them to consider, at any point, therefore, he is not entitled to relief.

Richardson currently is seeking relief in the Colorado Supreme court, but also addresses the public to stand with him against unfair treatment. Richardson currently resides in Mississippi and forgoes legal study seeking to practice law civil rights injuries.
