FREEDOM FOR TYRONE HINES' UNJUST MANDATORY SENTENCE
The Issue
PETITION ON BEHALF OF TYRONE HINES
Who has been Unjustly Sentenced…
Let me start with the “Summary of Facts”
During the period of at least 1990 through April 19, 1994, Tyrone Hines ran a Continuing Criminal Enterprise that the government contends distributed at least 45 kilograms of cocaine and over 100 kilograms of crack cocaine. These drugs was never charged in Hines' indictment or found in his possession. At the time he pled guilty and in his written plea agreement, Hines admitted the drug quantity. Following his guilty plea, the government wanted Hines to cooperate and testify in order to receive a sentence less than life. On May 9, 1995, Judge Frederick J. Scullin Jr. felt a sentence of 20 to 25 years was just. The government disagreed and recommended a sentence of mandatory life based on the drug amount. Judge Scullin sentenced Hines to a mandatory life sentence. The harsh sentence was imposed reluctantly.
There have been significant changes in federal drug laws since Hines pled guilty and was sentenced. Hines filed a petition late last year to vacate his sentence of life imprisonment "pursuant to the Holloway Doctrine". In his motion, Hines requested the court and government to take a second look at his punishment and resentence him to 20 or 25 years and release him immediately.
On February 8, 2016, the government had a chance to correct this injustice and release Hines immediately. After reviewing the facts of Hines' case, the government's position was that Hines is one of the biggest drug dealers in Syracuse history. He further stated: To the extent Hines' activities are aimed at helping others and to better himself, they are praiseworthy, but they award Hines no basis for undoing his sentence.
Hines is not the same person described by the government. Hines has been relatively well-behaved during his 22 years in prison:
HINES ACCOMPLISHMENTS- Good behavior is far more difficult to maintain for 20 years. Hines' disciplinary record while imprisoned consist of NO incident reports. (Remarkable). He has maintained employment for over 20 years. He has earned his G.E.D.; completed numerous educational programs such as: Drug Educational Program and the Alternative to Violence Project (AVP). Hines also have written and Self-Published 4 books. He also worked on a script with a Syracuse producer about an educational movie about his life.
GIVING BACK TO THE SYRACUSE COMMUNITY- In 1998, Hines founded the "Stop the Violence" Yellow Ribbon Campaign in Syracuse in memory of victims of violence. He asked everyone in Syracuse to wear yellow ribbons the whole month of October. "Convicts Launched Victims' March "60 Walk”, “Talk Down Violence"
In 2013, Hines started honoring Mothers in Syracuse presenting each mother with a statute to recognize their hard work of raising their families. In 2014, Hines also co-founded M.E.N. (Men Educating Neighborhoods) "Syracuse CeaseFire" a program where inmates from Syracuse encourages at-risk youth not to use or possess Illegal Firearms & Narcotics. Hines also provided the idea & concept for this year's Balloon Release Memorial held in Syracuse, at Billings Park.
HELPING OTHERS PRISONERS TO OBTAIN RELIEF IN COURT- Hines has helped many inmates to obtain relief from the courts. To many to name but here are a few...He has helped Kendall Brown, Marc "Imf" Stanley with obtaining relief. On Feb 8th, 2015, after working hard on Gregory Thomas aka Earl's case, the judge granted him an evidentiary hearing and remanded him back to court. He is presently waiting on a decision from the court that could determine how soon he will be home. In June of 2016, after working hard on another Syracusan's case (Darnell "Styles" Williams) the government agreed to remand his case back to court. Also in the same month, Rahmel Fisher from Brooklyn New York case was vacated and he is on his way back to court. Another great victory for Hines. Two Syracusans that he filed motions in the court and waiting for the decisions that could determine whether these dudes will be home soon. Gamale Gist and Dewayne "D-Carter" Carter. Over the years, Hines has worked on other dudes cases from Syracuse: Darquan Walker, Demetrius "Meech" Sullivan, Jason "Hood" Reed, another Syracusan was released a year early when Hines filed and won an administrative remedy requesting the BOP to run his state & federal sentence concurrent and many others and continues to HELP others.
Hines has demonstrated he has a very low likelihood of recidivism based on his reform in prison and research which shows that recidivism later declines as age increases. Overall, Hines has set forth credible evidence to show he has reformed himself and leaves behind his criminal past. The government overlooks how Hines can be an asset to the community--he is intelligent, entrepreneurial, of generally high character, and has special skills. Instead, the government thinks Hines' sentence is just even though Hines pled guilty and never was charged with any drug amount.
And with Hines being incarcerated he has missed out on the hands on of raising of his children he has done the best he could from behind bars. Hines has a huge support system friends and family from all over the United States that love and miss him dearly. We feel that he has served enough time for his crime, there are people doing much more dangerous crimes and are getting less time.....
Please help us bring Tyrone Hines home......
