Preserve the Colorado Noise Abatement Act - Stop SB26-098

The Issue

Many communities throughout Colorado are facing the issue of noise pollution from music promoters that have come into existing communities from Salida, to Colorado Springs, to Dillon to name a few, with more communities being impacted annually. These communities are home to a cross -section of Colorado , veterans with service-related disabilities, children, senior citizens, families, individuals with disabilities and people just wanting peaceful enjoyment of their homes in the beautiful state that they call home. Coloradans in these communities are facing thumping bass, lyrics, often profanity laced, and other concert noise invading the inside of their home for hours on end, multiple days a week, also effectively rendering outdoor spaces unusable in the warm weather months. They didn't go to the music the music came to them. Most of those affected actually enjoy music and concerts; they just want the same peaceful enjoyment of their homes that others enjoy.

 The Colorado Supreme Court recently ruled that local governments cannot override state law to allow noise in excess of the state noise pollution standards. Despite this ruling, The Colorado General Assembly is currently considering SB26-098, a piece of legislation that threatens to effectively dismantle the existing 1971 Noise Abatement Act (NNA). The NNA provides crucial protection for all Coloradans, safeguarding us against the harmful effects of noise pollution. If SB26-098 passes, it would create a patchwork of local regulations that could eliminate the uniform provisions currently in place, leading to increased noise pollution and diminished quality of life in all of our communities.

Noise pollution has far-reaching consequences on health, including increased stress, cardiovascular disease risk, sleep disturbances, and impaired learning in children, as outlined by reputable scientific studies (e.g., World Health Organization, 2018). The current Noise Abatement Act offers a standardized protection that has been vital in managing these risks across the state.

We urge lawmakers to uphold these protections by rejecting SB26-098. Our Colorado quality of life depends on decisive action to maintain robust noise pollution standards. Please join us in advocating for a safer, quieter environment for all Coloradans by signing this petition to protect the Noise Abatement Act.
