For the more than three years since sentencing and classification, Zeph has been trying to correct his "points" that could get him moved to a medium security facility instead of the extremely horrible dangerous Maximum security penitentiary. This past week in a meeting with the counselor, Zeph explained he should only have been given 3 points for gun possession (it can be 3, 5 or 7; Three is like they find it in your home, Five would be brandishing it pointing it at someone, etc. and 7 is for committing a crime with it, armed robbery and the like). They had given him 7 when he became property of the B.O.P. So this counselor said "It is because of your 'offence conduct'". Zeph:"There is no offence conduct I never even touched the guns". Officer:"But right here in your Pre-Sentencing Report that you got angry and pulled the gun on someone in a car and then jumped out and went to the bus stop". Zeph: "NO that was George, the helper unloading the Truck with all my Dad;s belongings, The guy who broke into a the locked box and stole two guns and ran off and my wife called the police; which is the only reason they even knew I had inherited them".
Since this is the third officer who read the Report and thought that was Zeph's behavior. (you have to read carefully to know it wasn't.) Did the Judge's clerk read it that way. did the Appeal judges read it that way??
