Policy reform on social media use by Lincoln County Sheriff
The Issue
Do you want our government offices to share your information on social media without your consent?
Are you comfortable with your information pertaining to official court documents being posted on sites like Facebook without your permission?
This petition is to support that the Lincoln County Sheriff’s Department and Lincoln County Court change policies on how and where they share information. So that they are protecting residence data privacy and not sharing basic resident information on social media platforms without consent.
In a time where data mining, selling, and stealing is rampant. Let’s ensure our law enforcement offices and government offices are doing their part to protect us. And allow them to help ensure we are in control of what is posted about us on social media platforms.
What needs to change…
The Sheriff’s department policy
3-15-501 subsection (8) subsection (a) subsection (iii) & subsection (c)
To be changed to:
(iii) government-controlled web pages for specific jurisdictions;
(c) attempted contact by other electronic communications including
(i) personal e-mail
(ii) text message to personal cell phone
Current Official policy…
(6) If a person fails to respond to the summons, the clerk of court shall attempt to contact a non responding person by telephone or other electronic communication.
(7) If a person fails to respond to the summons the clerk of court has completed the actions required in subsection (6), the clerk of court shall certify the failure to the sheriff, who shall make reasonable efforts to require the person to appear on the date required on summons.
(8) For purposes of subsection (7) “reasonable efforts” include the following actions:
(a)publishing the lists of persons to respond in or on any of the following:
(i) a newspaper of general circulation;
(ii) a web based news site;
(iii) government-controlled or government-sponsored social media or web pages for specific jurisdictions;
(b) attempted contact by telephone;
(c) attempted contact by other electronic communications;
(d) posting a physical notice at last-know address;
(e) attempted personal service; or
(f) attempted contact by United States postal service first class mail.
As of now the Lincoln County Sheriff’s department can share resident juror information via unregulated social media sites (Facebook) posts to the public as reasonable means of contacting specific people on a failure to respond to Juror Information Forms and Summons.
Argument:
Social Media sites are for-profit and unregulated. They do not send out information to specific areas, but to its entire platform, which is worldwide. Once information is posted on a platform like Facebook it becomes…
… a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on Facebook, you give us permission to store, copy, and share it with others (again, consistent with your settings) such as service providers that support our service or other Facebook Products you use. This license will end when your content is deleted from our systems.”
-Facebook, Terms and Agreements
In laymen’s terms you have given the rights to reuse; repost; sell or distribute to data brokers, use for proprietary Artificial Intelligence platforms or sell or share to Artificial Intelligence platforms.
