

***Reminder that these court proceedings are to obtain only a fraction of the evidence that we are legally entitled to and should have been disclosed but was denied***
1.Gilbert v Whitsunday Regional Council & Queensland police for CCTV
2.Gilbert v Queensland police for evidence pertaining to the prosecution of Constable Bryce Collins in relation to Luke Gilbert
- WRC has been ordered to file ALL documents in unredacted form.
- WRC must also file an affidavit confirming full disclosure to the court.
- WRC must explain how OIC knew QPS had the CCTV (the basis for their involvement), something they've avoided clarifying until now.
- QPS allege they have no further documents to file, but must formally confirm everything has now been disclosed to the court.
- The judge reviewed QPS redactions and allowed them to stand..
- Both cases will now move to a decision "on the papers" in July after final submissions.
Whitsunday Regional Council failed to adequately explain why they redacted the name and email of the staff member who disclosed the requested CCTV to the Information Commissioner during the OIC external review or how Queensland police became involved in the external review when the original RTI application was to WRC only.
This means that the court has recognised gaps in the evidence requested and has now required answers under oath before a determination can be made.
