The Issue
To Whom It May Concern,
We, the undersigned members of the Preservation District HomeOwners Association, hereby express our collective opposition to a proposed land swap by Smooth Wire LLC involving the 250-acre conservation easement deeded to Land Legacy. This easement is a vital component of our community, safeguarding the environmental integrity and aesthetic value of our neighborhood, which in turn supports the intrinsic and monetary value of our properties.
Background:
The conservation easement in question was established to preserve the natural beauty and ecological significance of our community. This agreement was intended to be perpetual, ensuring long-term conservation regardless of changes in ownership or management. The efforts by Smooth Wire LLC to renegotiate this easement threaten to undermine these protections, altering the character and environment of our neighborhood.
Our Concerns:
1. Environmental Impact: Any modification to the current easement could lead to increased development, adversely affecting local wildlife habitats and natural resources that our community cherishes.
2. Property Values: Altering the preserved land could potentially diminish the value of our properties by changing the very characteristics that make our neighborhood desirable.
3. Legal Integrity: The original easement agreement was made in good faith with the expectation of permanence. Any attempts to alter it without unanimous consent and thorough community consultation are contrary to the spirit of this agreement.
Our Position:
We stand firmly against any land swap proposal that might dilute the effectiveness of the current conservation easement. We are prepared to use all legal means necessary to maintain the integrity of the original agreement and ensure that the terms set forth are honored.
Our Request:
We urge Land Legacy to reject any proposals from Smooth Wire LLC that seek to alter the conservation easement without community input. Furthermore, we request that any discussions of modifications to the easement involve full transparency and active participation from our community. Lastly we urge Land Legacy to uphold their fiduciary responsibility to maintain and ensure the rights of access to the easement, granted to the residents of the Preservation District according to their recorded deed.
We trust that our concerns will be taken seriously, and we expect a commitment from all parties involved to uphold the conditions of the original easement agreement. Our community is prepared to engage through all necessary legal channels to protect our rights and the conservation values of our neighborhood.
