Petition to review NSW’s 120-Hour Learner Driver Requirement
The issue
In New South Wales, learner drivers are required to complete 120 hours of supervised driving before they can apply for a provisional licence. This number is higher than in any other Australian State or Territory, with the exception of Victoria, and poses significant challenges for those who do not have immediate access to a supervising driver or vehicle, or who cannot afford the cost of driving lessons with a professional driving instructor - such as the young parents I support every day.
The impact is profound and far-reaching. Without a driver's licence, these individuals face difficulties accessing employment opportunities, healthcare services, educational institutions, and even simple tasks like grocery shopping become an ordeal.
In Tasmania the minimum number of supervised driving hours is 80 hours. In the ACT it is 100 hours. In Western Australia 50 hours, and 75 hours in South Australia. In Victoria and Queensland this number is 120 hours and 100 hours respectively. However, in both those States an exemption from this requirement can be applied-for in situations of undue hardship.
The NSW 120-hour supervised driving requirement was introduced to improve road safety for learner drivers.
While road safety is extremely important, the current system creates major barriers for many capable learners who:
- do not have regular access to a supervising driver,
- cannot afford extensive driving practice,
- work or study long hours,
- or lack consistent family support.
For many people, completing 120 hours is not simply difficult — it can be financially and logistically unrealistic.
The current system also measures time spent driving rather than demonstrated driving competence. Some learners become safe and capable drivers through structured training and focused instruction in substantially fewer hours.
We are calling on the NSW Government to:
- review the mandatory 120-hour requirement,
- investigate competency-based alternatives,
- consult learners, families, instructors, and road safety experts,
- and create a fairer, more accessible pathway to obtaining a licence while maintaining strong safety standards.
A driver licence affects employment, education, independence, and quality of life. NSW should ensure the licensing system is both safe and equitable.
