Petition to Require By-Elections for Members of Parliament Who Cross the Floor
The Issue
TO THE HOUSE OF COMMONS OF CANADA:
WHEREAS:
Members of Parliament are elected by their constituents based largely on their party affiliation, platform, and values;
Canadians cast their votes with the expectation that their chosen representative will advocate for the policies and principles of the party they campaigned under;
When an MP crosses the floor to join another party, they fundamentally change the political representation that voters chose, without any accountability to those voters;
Floor-crossing can alter the balance of power in Parliament, potentially changing which party forms government or holds majority status, thereby affecting the democratic will expressed by all Canadians in the previous election;
The current system allows MPs to switch parties without consequence, creating opportunities for political manipulation and undermining public trust in democratic institutions;
While MPs should represent their conscience and constituents, the modern reality is that party affiliation is a primary factor in how Canadians vote;
SPECIFIC CONCERNS:
Democratic Accountability: Voters elect representatives based on their party platform. When an MP switches parties, constituents lose the representation they voted for without having any say in the matter.
Balance of Power: An MP crossing the floor can shift whether a government has a majority or minority, fundamentally altering the parliamentary dynamic that voters established through their collective votes.
Potential for Corruption: Without consequences for floor-crossing, MPs could potentially be incentivized to switch parties through promises of cabinet positions, patronage appointments, or other benefits, rather than based on genuine principle.
Erosion of Public Trust: When MPs can freely switch parties without facing voters, it reinforces cynicism about politicians prioritizing their own interests over democratic accountability.
Provincial Precedent: British Columbia has implemented recall legislation, demonstrating that accountability mechanisms for elected representatives are both feasible and constitutional.
WE, THE UNDERSIGNED, PETITION THE GOVERNMENT OF CANADA TO:
Introduce legislation requiring that any Member of Parliament who leaves their party to join another party, or who is expelled from their party and subsequently joins another party, must:
Resign their seat and trigger a by-election in their riding, allowing constituents to decide whether to re-elect them under their new party affiliation; OR
Sit as an independent member for the remainder of the parliamentary term without joining another party.
Exception: MPs who leave their party to sit as independents without joining another party would not be required to trigger a by-election, preserving the principle that MPs can act on conscience while preventing party-switching without voter approval.
This legislation would restore democratic accountability, protect the integrity of our electoral system, and ensure that the political representation Canadians vote for is the representation they receive.
