Petition to Reevaluate the Vista Nueva Project and Investigate Oversight and Mismanagement by Jamboree Housing Corporation and Domus Property Management

To Whom It May Concern,

We, the undersigned, respectfully submit this petition demanding an immediate reevaluation of the Vista Nueva Project-Based Housing and the oversight and management provided by Jamboree Housing Corporation, SHRA, HUD, HCD, Domus Property Management, and their on-site staff, from October 2021 to the present.

We are deeply concerned about the unacceptable living conditions, mismanagement, and ethical violations that have directly impacted the first 117 families who were placed in these units. These families were relocated under false pretenses and have been subjected to hazardous living environments that include mold, dust, and unfinished renovations—conditions that not only violated basic health and safety standards, but also undermined the dignity of families who were promised secure, safe, and supportive housing.

These actions have had serious and lasting consequences for our community, and we believe that immediate action must be taken to address the following:

1. False Promises and Misleading Information
Families were relocated under the impression that they would be moving into renovated housing units that would provide a better, healthier environment. Instead, the reality was far from the promise—families were placed in units filled with mold, dust, and uncompleted construction, and the conditions have left residents in an unsafe and unhealthy living environment.

2. Ethical Violations and Exploitation of Resources
We believe that the project was used as a means for financial gain by Jamboree Housing Corporation and Domus Property Management at the expense of vulnerable families. The lack of basic services, inadequate amenities, and failure to provide essential resources for residents represents not only a violation of ethical standards but also a gross misuse of public housing resources that should have been directed toward improving the lives of the families in need.

3. Lack of Accountability and Support
The staff members at both Jamboree and Domus Property Management failed to adequately address the residents' concerns and created a toxic environment where residents felt threatened and unsupported. Their actions, and lack thereof, resulted in an atmosphere of stress, fear, and disrespect for residents who were already facing significant challenges in their lives.

4. Health and Safety Risks
The living conditions at Vista Nueva have created serious health risks, with mold, pests, and structural defects left unaddressed for far too long. These conditions have been exacerbated by the lack of timely maintenance and failure to follow minimum housing standards, which have made it impossible for families to live in a healthy and secure environment.

Our Demands:
We respectfully demand the following actions to hold Jamboree Housing Corporation, Domus Property Management, and their staff accountable for the harm they have caused:

Immediate Reevaluation of the Vista Nueva Project: A thorough review of the project and its current state, including an assessment of the conditions in all units, the adequacy of renovation work, and whether the housing meets minimum health and safety standards. This reevaluation should be conducted by an independent third party to ensure impartiality.

Investigation of Jamboree Housing Corporation and Domus Property Management: We call for a formal investigation into the actions and practices of Jamboree and Domus Property Management during their oversight of the Vista Nueva project. This investigation should include an examination of their misleading marketing, failure to maintain safe conditions, and potential exploitation of housing resources for financial gain.

Leave of Absence for Staff Involved: Given the gravity of these violations and the harm done to the residents, we request that the staff involved in overseeing the project, including those from Jamboree Housing Corporation, Domus Property Management, and any involved property management staff, be placed on leave until a full investigation is completed. This will help ensure a fair process and prevent further harm to residents.

Full Compensation for Affected Families: We demand that the first 117 families who were placed in these units under false pretenses receive appropriate compensation.
For each family we demand a 50% percent reimbursement of the entire cost that was issued to Jamborree based on the calculation that was delegated to maintain our housing and other resources. For the suffering, disruption, and health risks they have faced as a result of these mismanagement practices.
Also that the remaining families without their HCV voucher be granted them as promised. No matter what we were reassured every tenant would acquire Section 8.
Compensation should also include access to alternative housing solutions while Vista Nueva is being evaluated and properly addressed. For those whom still reside at Vista Nueva based on one Abuse of power, Intimidation, discrimination etc.

Immediate Action to Address Health and Safety Issues: We urge the housing authority and all involved parties to take immediate action to resolve the health and safety issues at Vista Nueva, including proper mold remediation, the provision of necessary amenities, and timely repairs to ensure that families can live in safe, clean, and habitable conditions.

Conclusion
We are asking for justice and accountability for the families who have been wronged by the mismanagement and unethical actions of Jamboree Housing Corporation, Domus Property Management, and the staff who have been involved in the Vista Nueva project. The conditions at Vista Nueva are unacceptable and must be addressed immediately to prevent further harm.

We call on those with the power to make change to act swiftly and responsibly to ensure that no family is forced to endure the hardships that have been inflicted upon the residents of Vista Nueva.

By signing this petition, we stand in solidarity with the families who have been impacted and demand immediate action to hold those responsible accountable.

Other terms related to this:
Bullying: A more generalized term, especially when authority figures target individuals in ways that create fear or stress.
Duress: A legal term referring to threats or coercion used to force someone into a situation or decision against their will.
Retaliation: When fear of punishment or negative consequences is used as leverage, especially after someone takes an action that authority figures disagree with.
If this is happening in a setting like housing, work, or any institutional environment, it's an abuse of authority and can be a violation of ethical or legal standards, depending on the situation

Legal Violations
Fair Housing Act (FHA) – Discrimination: The Fair Housing Act prohibits discrimination in housing based on race, color, national origin, religion, sex, familial status, or disability. In a public housing environment, violations could occur if tenants or applicants are treated unfairly or harassed due to these protected characteristics.

Examples:
Discriminating against families with children by limiting access to housing or amenities.
Harassing or retaliating against tenants who file complaints about conditions or discrimination.
Failing to provide accommodations for individuals with disabilities (e.g., not making units accessible or denying support services).
Housing and Urban Development (HUD) Regulations: Public housing authorities are required to comply with HUD regulations that govern how housing is administered, including eligibility requirements, tenant protections, and procedures for placing tenants into available units. Violations include:

Failure to maintain habitable conditions: Public housing must meet minimum housing standards regarding safety, cleanliness, and basic facilities (e.g., plumbing, heating, mold-free units). If residents are placed in conditions with unsafe living environments or unaddressed health hazards, this could be a violation of HUD standards.
Improper eviction practices: Public housing authorities are required to follow specific due process procedures when evicting a tenant. This includes providing notices and fair hearings, as well as ensuring that evictions are not punitive or retaliatory.
Americans with Disabilities Act (ADA): The ADA mandates that housing programs, including public housing, must be accessible to individuals with disabilities. Violations occur if a housing authority does not provide accessible units or deny reasonable accommodations to tenants with disabilities.

Examples:
Not providing accommodations such as accessible parking, doorways, or bathroom facilities.
Discriminating against disabled tenants by not offering equal treatment in housing opportunities.
Retaliation Laws: Federal, state, and local laws prohibit retaliation against tenants who assert their rights or file complaints against their landlord or housing authority. Retaliatory actions may include:

Unfair eviction or harassment after a tenant files a complaint about conditions like mold, pests, or maintenance issues.
Threats or intimidation aimed at silencing tenants who speak out or seek legal recourse.
Tenant’s Right to Privacy: Tenants in public housing have a right to privacy in their homes. The public housing authority must follow proper legal procedures to enter units (e.g., providing notice, obtaining consent, or having an emergency reason for entry). Violations could involve unlawful entry into a tenant's unit without proper notice or cause.

The Rehabilitation Act of 1973: Section 504 of this act prohibits discrimination against individuals with disabilities in federally funded programs, including public housing. Violations occur when tenants with disabilities are not provided with necessary accommodations or face unequal treatment.

Ethical Violations
Abuse of Power and Authority: Public housing authorities and staff are entrusted with ensuring that tenants' needs are met fairly. When individuals in power use intimidation, threats, or coercion to influence tenants' behavior or decisions, this is an abuse of power.

Examples:
Threatening families with eviction or other penalties to force compliance or silence complaints.
Using their position to intimidate tenants into accepting unsafe or inadequate living conditions.
Failure to Provide Adequate Support and Services: Public housing is meant to support vulnerable individuals and families. When housing authorities fail to meet tenants' needs, such as by not providing adequate social services, job training, or career resources, it is an ethical violation. Vulnerable tenants are then left without the support necessary to improve their circumstances.

Examples:
Neglecting to provide resources for job training or career development, which is essential for tenant self-sufficiency.
Failure to provide essential amenities or safe living conditions.
Lack of Transparency and Accountability: An ethical violation occurs when housing authorities operate in secret or fail to communicate honestly and transparently with tenants regarding their housing conditions, waiting lists, or rights. Tenants should be provided with clear, accurate information about their housing status, renovations, and timelines.

Examples:
Providing false information about renovations or housing availability.
Failure to respond to tenant complaints or requests for repairs and support.
Discrimination and Unequal Treatment: Discrimination goes against the core ethical principles of fairness and equality in public housing. Ethical violations occur when certain tenants are treated unfairly or unequally due to their background, disability, family status, or other protected characteristics.

Examples:
Differential treatment of tenants based on race, religion, or family size.
Offering better units or services to certain tenants while neglecting others.
Failure to Maintain Safe and Healthy Living Conditions: Public housing authorities are ethically obligated to ensure that housing units are safe, clean, and healthy. This includes regular maintenance and inspections to prevent hazards like mold, leaks, and structural damage. Neglecting to maintain basic safety standards is both an ethical and legal violation.

Examples:
Ignoring complaints about mold or unsafe conditions.
Delaying repairs or failing to provide timely solutions, thereby putting tenants at risk of injury or illness.
Conclusion
In a project-based public housing authority setting, violations of legal and ethical standards can have serious consequences for residents. It is essential for housing authorities to operate transparently, fairly, and with respect for the safety, well-being, and rights of tenants. Failure to meet these standards can result in harm to vulnerable families, legal consequences for the housing authority, and a breakdown of trust between the community and the agency meant to serve them.
