Petition to NC General Assembly: Authorize Recall Elections in Swansboro Town Charter

The Issue

We, the undersigned registered voters of the Town of Swansboro, Onslow County, North Carolina, respectfully petition the North Carolina General Assembly to enact a local act amending the Charter of the Town of Swansboro to authorize the recall of elected officials.

Specifically, we request that the General Assembly amend the Charter of the Town of Swansboro, as set forth in Chapter 561 of the Session Laws of 1971, to add the following:

Section [X]. Recall of Elected Officials.

(a) Any elected officer of the Town of Swansboro may be removed from office by the qualified voters of the Town in a recall election.

(b) A recall election shall be called when a petition signed by not less than twenty-five percent (25%) of the qualified voters of the Town, as shown by the most recent municipal election records, is filed with the Onslow County Board of Elections.

(c) The petition shall contain the name of the officer whose removal is sought and a general statement of the grounds for removal. The sufficiency of the petition shall be determined by the Board of Elections.

(d) A recall election shall be conducted in the same manner as other municipal elections, and if a majority of votes cast favor removal, the office shall be declared vacant, and the vacancy shall be filled as provided by law.

(e) No recall petition shall be filed within the first six (6) months or the last six (6) months of an officer’s term, nor within six (6) months after an unsuccessful recall election against the same officer.

We further request that the General Assembly enact any necessary provisions to implement and enforce this recall authority.
