SAN DIEGO SUPERIOR COURT JUDGE RICHARD S. WHITNEY MUST BE REMOVED FOR CORRUPTION, CIVIL RIGHTS VIOLATIONS, AND CRIMINAL ENTERPRISE UNDER RICO

We, the undersigned, call for the immediate investigation, removal, and prosecution of Judge Richard S. Whitney of the San Diego Superior Court. Judge Whitney has brought the judiciary into disrepute by participating in a coordinated RICO enterprise involving school district officials, public attorneys, and insurance defense networks that have misappropriated taxpayer funds, abused the courts, and inflicted harm on children and families.

Why This Matters:
After a parent lawfully criticized the Del Mar Union School District (DMUSD) and its Superintendent Holly McClurg for retaliation and mistreatment of her son, the district initiated a campaign of legal harassment. Three sham restraining orders were filed based on fabricated facts. These retaliatory filings were orchestrated by government-contracted, for-profit Joint Powers Authority (JPA) insurance attorney Daniel R. Shinoff, who signed petitions under penalty of perjury for individuals based on false facts he could not have personal knowledge of.

Attorney Shinoff then coordinated with Judge Whitney through undisclosed ex parte communications. These hearings were strategically moved to Department 68—where Shinoff frequently moves cases. Multiple closed-door meetings between Judge Whitney and district attorneys occurred without the parent's consent, in direct violation of Constitutional Due Process and the Code of Judicial Ethics.

Abuse of Power and Taxpayer Funds:
Superintendent McClurg and DMUSD used taxpayer dollars to finance personal vendettas. Shinoff, through public funds, defamed the parent as a "School Shooter" in open court, despite no threats or credible allegations. This false narrative was adopted by Judge Whitney, who granted the sham restraining orders and repeatedly referred to the parent as a "Domestic Terrorist" for sending emails, requesting meetings, and advocating for her child.

Further Misconduct:

• DMUSD administrators deleted text messages related to the alleged incident.
  The school never called police or conducted any investigation.
  A security guard was hired to harass the parent's minor child, shouting through a megaphone outside of school.
  The child became truant, missed over 50 days of school, and was excluded from key school events.
  Parent was barred from school functions despite posing no risk.

Even after the child left DMUSD, the harassment continued. Shinoff and DMUSD attorneys dragged the parent back into court, calling her a "vexatious litigant" simply for defending herself. More litigation followed when they claimed she violated a restraining order by dropping her child off 160 yards away instead of 200.

Despite providing proof of perjury, obstruction, and retaliation to District Attorney Summer Stephan’s office, the parent received no response. DA Stephan had previously attended a campaign fundraiser hosted at Shinoff’s private $5 million home.

Additionally, Shinoff and his law partners reportedly co-own properties with judges in San Diego. These are glaring conflicts that call into question the integrity of court proceedings.
