Higher education institutions are entrusted with safeguarding student rights, maintaining accurate records, and fostering an environment free from retaliation. However, there is growing concern over systemic record manipulation, administrative retaliation, and a lack of transparency, particularly when students report misconduct, discrimination, or procedural failures.
Reports from students across the country reveal instances where universities have altered academic records, misrepresented enrollment statuses, and obstructed access to critical academic and financial information—often in ways that disadvantage those who speak out. These practices undermine the integrity of the education system and violate federal laws, including the Family Educational Rights and Privacy Act (FERPA) and the Americans with Disabilities Act (ADA).
This petition calls on policymakers, educational oversight agencies, and the public to recognize and address this urgent issue by implementing stronger protections, independent oversight, and greater institutional accountability.
SYSTEMIC ISSUES OF CONCERN
Record Tampering & Misrepresentation
- Some institutions have modified student records without notice or justification, impacting academic standing, financial aid eligibility, and professional opportunities.
- Unilateral changes to enrollment status, withdrawal dates, and disciplinary records have been used to obscure institutional failures and suppress student complaints.
Retaliation Against Students Who Raise Concerns
- There have been numerous reports of students facing administrative retaliation—including psychological evaluations, enrollment barriers, and disciplinary actions—after reporting harassment, discrimination, or institutional misconduct.
- These practices create a culture of intimidation rather than accountability, deterring students from advocating for their rights.
Lack of Transparency & FERPA Violations
- Under FERPA (20 U.S.C. § 1232g; 34 C.F.R. Part 99), students have the right to access and request corrections to their records, yet many institutions fail to comply.
- Opaque administrative processes prevent students from seeing internal records, modifications, and decision-making that directly impact their education.
Financial Aid & Enrollment Manipulation
- Students have reported being forced into financial aid exit interviews, assigned altered withdrawal dates without consent, or misled about financial obligations, often affecting loan repayment and future aid eligibility.
- Federal financial aid regulations require transparency, but many institutions fail to provide clear, timely communication regarding account changes.
PROPOSED REFORMS & POLICY SOLUTIONS
To ensure transparency, accountability, and student protections, we call on the U.S. Department of Education, the Office for Civil Rights (OCR), lawmakers, and state education agencies to implement the following measures:
Independent Oversight of Student Record Modifications
- Institutions must maintain a detailed audit trail for all student record modifications, including timestamps, personnel involved, and justification for each change.
- Any modification affecting enrollment, disciplinary status, or financial aid should be subject to independent review to prevent misuse.
Strengthened Enforcement of FERPA Protections
- The U.S. Department of Education must increase penalties for institutions that engage in record tampering, obstruct access to records, or refuse to correct inaccuracies.
- Students need clearer legal pathways to challenge FERPA violations and seek redress when institutions violate their rights.
Prohibition of Retaliatory Enrollment Changes & Psychological Evaluations
- Universities must not alter a student’s enrollment status without clear documentation and informed consent.
- Psychological evaluations must not be misused as a tool for intimidation or retaliation against students who report misconduct or request accommodations.
Financial Aid & Enrollment Transparency Requirements
- All financial aid and enrollment changes must be communicated in writing before implementation, allowing students an opportunity to challenge inaccuracies.
- Students must not be pressured into exit interviews or financial agreements based on unverified records.
Public Accountability for Institutions That Engage in Misconduct
- A public registry should track verified complaints and violations related to student record falsification and institutional retaliation.
- Institutions found responsible for serious violations should face sanctions, including restrictions on federal funding.
