Petition to Deny LEGl-2024-0012: Special Exception Permit for Happy Paws K-9
The Issue
We, the undersigned residents of Loudoun County, Virginia, hereby urgently and collectively oppose the application LEGl-2024-0012, submitted on behalf of Happy Paws K-9, to operate a commercial dog kennel at 20492 Oatlands Chase Place, Leesburg, VA. We request that the Loudoun County Planning Commission and Board of Supervisors deny this permit based on the following reasons:
Key Concerns and Reasons for Opposition:
1. Zoning Violations and Incompatibility
This property resides in an AR-1 (Agricultural Rural-1) zone, designated for low-density residential and rural use, explicitly restricted from commercial animal services such as dog kennels. The proposed operation violates County Zoning Ordinance and the Use-Specific Standard Section 4.02.03 for Live/Work Dwellings, which clearly prohibit animal services and kennels in a single-family home in rural, residential zones. Approving this would set a dangerous precedent, allowing commercial entities to operate in areas intended for low-impact, residential living, contradicting the County's long-term planning goals.
2. Disruption to Rural Peace and Community Character
The operation of a 40-dog facility would generate significant noise pollution through barking, disturb the tranquility of our semi-rural neighborhood, and introduce urban-scale nuisances incompatible with our community. The County’s noise ordinances typically limit residential noise levels to 55-65 decibels; noise from this kennel would far exceed acceptable levels, especially during evenings and weekends.
3. Traffic Congestion and Safety Hazards
An estimated 160+ daily vehicle trips (drop-offs and pick-ups) will result from this operation, far surpassing the capacity of our narrow rural roads such as Oatlands Chase Place. This increased traffic raises concerns about accidents, pedestrian safety, school bus stops and the ability of infrastructure to accommodate such volume, especially during peak hours.
4. Environmental and Waste Management Risks
The outdoor dog pen, located without adequate setback, at the top of a hill poses risks of unabated, contaminated runoff into neighboring properties and local water sources. Violations include inadequate stormwater management and violations of state health and environmental laws, risking pollution of wetlands and local waterways, which could lead to costly remediation and serious, life-threatening health risks for residents in the area.
5. Zoning Incompatibility and Property Value Erosion
This proposed commercial activity undermines the County's emphasis on maintaining low-density, rural, residential communities. It threatens property values and the aesthetic integrity of our neighborhood, leading to potential economic decline, property value erosion and deterring future investment.
6. Broader Community Disruption
As residents, (not Happy Paws customers), we value our semi-rural lifestyle, which is under threat from this proposed operation. Community opposition has already surfaced through social media, Emails to the County, neighbor outreach, numerous complaints and petitions. Granting this permit would disregard our community’s very voice and priorities, particularly in the context of the 2024 electoral focus on neighborhood preservation.
7. Existing Complaints and County Citations
The County has received numerous complaints regarding Happy Paws K-9 from residents related to traffic, noise, dog fights, contamination, smell, septic issues, and violations of zoning regulations. Approval would endorse and exacerbate these ongoing conflicts and undermine community trust in County oversight.
Our Request:
We respectfully request that the Loudoun County Planning Commission and Board of Supervisors deny application LEGl-2024-0012 during upcoming public hearings. Should the application proceed, we ask that severe conditions be imposed by the County -- including indoor-only operations (no outdoor dog pen), strict dog capacity limits to less than 10 dogs, and substantial noise mitigation, including enhanced berms and vegetative barriers -- to prevent this operation from continuing their most disruptive, objectionable activities or recklessly expanding.
Our Community’s Priority:
We seek decisions from the County that uphold the integrity of our residential neighborhood, protect our rural character, and prevent the erosion of property values and quality of life. We strongly oppose the commercial kennel operations in our neighborhood and urge the County to uphold the zoning laws and community standards designed to preserve our way of life.
