The Issue
Protect Natural Hemp, CBD Wellness, and Small Farms - Amend H.R. 5371
A National Call Led by Top Tier Organics
Petition Statement
We ask Congress to amend H.R. 5371 to protect natural hemp products, small farms, wellness brands, and consumers nationwide. This petition is organized by Top Tier Organics, a developing regenerative farm and wellness initiative focused on clean agriculture, education, and community centered advocacy.
H.R. 5371 was intended to target unsafe synthetic cannabinoids. Instead, the current wording intentionally removes access to natural hemp derived products, harms farmers, eliminates small businesses, and disrupts rural economies.
Top Tier Organics supports responsible regulation. We do not support a law that bans natural hemp extracts, punishes non intoxicating wellness products, and fails to distinguish between natural cannabinoids and synthetic conversions.
Why This Petition Matters
1. Natural hemp and CBD wellness products become illegal
The 0.4 mg THC per container rule would ban full spectrum CBD, broad spectrum CBD, minor cannabinoids, tinctures, and naturally occurring hemp extracts. This affects millions of consumers who use these products for wellness.
2. Farmers and developing agricultural ventures are harmed
Hemp farms, including emerging regenerative projects like Top Tier Organics, rely on a healthy natural hemp market to grow, hire, and operate. H.R. 5371 removes the economic foundation these farms need to launch and sustain operations.
3. Small businesses lose their entire industry
The current rule would eliminate thousands of CBD companies, wellness brands, and retailers that support local communities and rural commerce. This shifts the market toward large corporations while eliminating small operators.
4. Consumer access and safety decline
With natural products banned, consumers turn to unregulated online sources. Unsafe synthetic cannabinoids continue to circulate because the bill does not address them directly.
5. The bill fails to separate natural hemp from synthetic cannabinoids
Top Tier Organics advocates for a clear distinction. Natural cannabinoids should remain legal. Chemically converted intoxicants should be restricted.
Requested Amendments to H.R. 5371
1. Remove the 0.4 mg THC per container rule
Replace it with realistic limits that reflect natural plant chemistry and modern testing standards.
2. Clearly ban synthetic or chemically converted cannabinoids
Delta 8, delta 10, HHC, and similar synthetics should be regulated without eliminating natural hemp.
3. Protect natural full spectrum and broad spectrum hemp extracts
These grow directly in the plant and contain non intoxicating trace cannabinoids.
4. Allow minor cannabinoids with proper testing
CBG, CBN, CBC, THCV, and related hemp compounds should remain accessible to consumers.
5. Require national testing and labeling standards
This protects consumer safety more effectively than a blanket ban.
6. Establish a one year compliance window
A fair transition period gives brands, farms, and future producers the ability to adapt responsibly.
