Petition: Support the Patient Right to Record Act

To the Washington State Legislature:

 

Patients deserve the right to record their own medical visits. Too often, important details are forgotten, omitted, or misrepresented in medical records. Without a recording, patients, especially those with rare diseases, chronic illnesses, or disabilities, are left without evidence when mistakes happen or when their voices are dismissed.

A significant percentage of patients report inaccuracies in their healthcare documentation. According to a study published in the Journal of Medical Internet Research, more than 20% of patients who accessed their medical records online found errors in at least one area of their health data. This is not just a statistic; it represents real people facing real outcomes based on potentially flawed information.

For individuals with complex medical histories, the ability to record medical visits can be a lifeline. It ensures that every concern they voice is accurately documented and can be revisited if necessary. This is crucial not just for accountability purposes, but also for continuity of care and patient peace of mind. 

Washington law (RCW 9.73.030) requires consent from all parties to record private conversations. This law, combined with restrictive hospital policies, means patients are often outright denied the ability to document their own care.

We believe this must change. Patients should not have to fight to preserve their own medical truth.

 
We, the undersigned, call on Washington State lawmakers to pass the Patient Right to Record Act, which will:

  • Affirm the right of patients to audio-record their own medical encounters.
  • Ensure compliance with existing consent law by requiring a simple on-record announcement.
  • Prohibit hospitals and clinics from imposing blanket bans on recordings.
  • Allow only narrow restrictions to protect other patients’ privacy and safety.
  • Require facilities to post clear recording policies.
    Protect patients from retaliation when they lawfully record their own care.
     
    Why this matters:
  • Improves accuracy of medical advice and treatment.
  • Provides accountability and transparency in healthcare.
  • Empowers patients and families, especially the most vulnerable.
  • Strengthens, not weakens, the patient–provider relationship.
