We, the undersigned, call for the immediate investigation and removal of Judge Mark B. Cohen from his judicial position due to serious concerns of judicial misconduct, violation of Philadelphia Family Law standards, and a pattern of decisions that endanger child welfare and compromise the integrity of the judicial system.

I am writing to petition for the removal of Judge Mark B. Cohen due to potential violations of Philadelphia Family Law and judicial misconduct in the handling of my custody hearing on December 17, 2020. This hearing resulted in an unjust and potentially biased custody decision that has adversely affected my children and me.

Violation of Right to Fair Hearing: Judge Cohen rushed the proceedings, significantly limiting my ability to effectively question witnesses and present my evidence. Crucial evidence of verbal and emotional abuse, as well as the father's criminal history, was dismissed as "too old," despite its relevance and recent occurrence (from October of the same year).

Failure to Consider Evidence of Abuse: The testimony from the CUA (Children and Youth Agency) regarding the physical abuse of our Autistic son by the father was egregiously overlooked. Additionally, reports of the father's illegal withholding of the children, which directly violated our current custody order, were ignored.

Potential Judicial Bias: It has come to my attention that the father admitted during a Modification Conference on October 26, 2022, to having communicated with Judge Cohen via Facebook for guidance on filing a PFA against me. This admission raises serious concerns regarding Judge Cohen's impartiality and adherence to judicial ethics. His decision to grant sole legal custody to the father, despite overwhelming evidence of the father's abusive behavior and criminal history, underscores this potential bias.

Procedural Irregularities: I experienced a delayed issuance of the custody order, which I received on January 5, 2021, impeding my ability to seek timely legal assistance for an appeal. There was a clear disregard for professional testimony and evidence, which was overshadowed by subjective and potentially biased statements. Furthermore, I was ejected from the virtual hearing before its conclusion and was not present when the hearing resumed, effectively denying me the opportunity to fully participate in or respond to the proceedings.

Endangerment of Child Welfare: The custody arrangement imposed restricts my access to the children to one daytime visit per week. This decision blatantly ignores CUA's testimony of my suitability as a parent and the absence of safety threats in my home, placing my children in a potentially harmful environment.

Denial of Emergency Hearing Following Assault: Following a severe assault against me by the children's father, which involved the use of a firearm in front of our children, Judge Cohen removed previously established safety measures for child exchanges. His refusal to grant an emergency hearing, despite the children's father being incarcerated for the assault, highlights a failure to prioritize my children's safety and well-being.

The serious allegations against Judge Mark B. Cohen necessitate immediate attention and action. For the sake of justice, fairness, and the welfare of our community's children, we ask for your signature in support of this petition to remove Judge Mark B. Cohen from his position.
