PETITION FOR THE REMOVAL, INVESTIGATION, AND DISBARMENT REVIEW OF COMMONWEALTH’S ATTORNEY BRETT HALL OF WISE COUNTY, VIRGINIA

To the Virginia State Bar, the Attorney General of Virginia, the Virginia Judicial System, elected officials of the Commonwealth, and the citizens of Virginia:

We, the undersigned, call for an immediate independent investigation into Wise County Commonwealth’s Attorney Brett Hall and request a formal review of his fitness to continue serving in public office following the continued failure to prosecute serious allegations of abuse and misconduct connected to Wallens Ridge State Prison and the death of Aubrey McKay.

The recent CBS News coverage regarding the death of Aubrey McKay has intensified public outrage and renewed longstanding concerns about accountability within Wise County and the Virginia Department of Corrections system. According to reporting and witness accounts referenced publicly, serious allegations involving correctional staff violence and abuse have persisted for years while meaningful prosecutions remain virtually nonexistent.

This pattern has created a widespread perception among citizens, families, advocates, and formerly incarcerated individuals that the justice system in Wise County is structurally incapable of impartially policing misconduct connected to the prison system.

Wise County’s economy and institutions are deeply intertwined with the prison industry. Many residents work within corrections, law enforcement, courts, or related government systems. Whether intentional or not, this overlap creates the appearance of conflicts of interest that severely undermine public trust in the impartial administration of justice.

The issue before the public is not merely one individual case. It is a broader concern that allegations of correctional officer brutality, abuse, retaliation, and excessive force are routinely ignored, minimized, or left unprosecuted despite repeated complaints, lawsuits, media investigations, witness testimony, and mounting public concern.

The death of Aubrey McKay has become a symbol of this crisis.

When citizens see allegations of extreme violence followed by little or no prosecutorial action, confidence in the justice system collapses. When communities believe prosecutors are too politically connected, institutionally dependent, or socially entangled to hold local power structures accountable, the rule of law itself is called into question.

This petition therefore demands:

An independent outside investigation into prosecutorial decisions connected to alleged abuse and deaths involving Wallens Ridge State Prison and other regional correctional facilities.
A review by the Virginia State Bar into whether Commonwealth’s Attorney Brett Hall has fulfilled his ethical and professional obligations to impartially pursue justice.
The appointment of independent prosecutors in cases involving correctional officer violence or in-custody deaths in Southwest Virginia.
Full transparency regarding investigations into the death of Aubrey McKay and any related prosecutorial determinations.
Legislative hearings examining potential systemic conflicts of interest between local prosecutors, correctional institutions, and regional political structures.
The people of Virginia deserve a justice system where no person is above the law, including government officials and correctional staff. Public office is a public trust. When that trust erodes, oversight and accountability become necessary.

This petition is not an accusation of criminal guilt. It is a call for transparency, accountability, independent review, and restoration of public confidence in the administration of justice in Wise County and the Commonwealth of Virginia.

Justice cannot depend on geography, political relationships, or institutional loyalty.

Justice must belong to the people.
