Petition for the Impeachment of Justices Thomas and Alito

Petition for the Impeachment of Justices Thomas and Alito
The Issue
To: The Members of the U.S. House of Representatives
We, the undersigned citizens of the United States, respectfully petition Congress to initiate impeachment proceedings against Supreme Court Justices Clarence Thomas and Samuel Alito for repeated ethical violations, conflicts of interest, and failures to disclose gifts and financial benefits as required by federal law and judicial ethics codes. These actions undermine public trust in the judiciary and violate the principles of impartiality and accountability essential to the integrity of the Supreme Court.
Detailed Grounds for Impeachment:
Justice Clarence Thomas:
Failure to Disclose Lavish Gifts:
-Justice Thomas failed to report luxury trips funded by billionaire Harlan Crow, including vacations to Indonesia, California, and private resorts, as well as private jet travel and yacht excursions. These omissions violate 5 U.S.C. §§ 7351 and 7353, which prohibit judges from accepting gifts that could influence their duties or create an appearance of impropriety.
-Crow also purchased $133,000 worth of property from Thomas, allowing Thomas’s mother to reside there rent-free. This transaction was not disclosed in financial filings until recently, raising questions about transparency and ethics.
Conflicts of Interest:
-Despite receiving substantial financial benefits from Crow, who has ties to conservative causes, Thomas did not recuse himself from cases involving issues aligned with Crow’s interests. This violates the Model Code of Judicial Conduct, which requires judges to avoid even the appearance of bias.
-Thomas also failed to recuse himself from cases related to efforts to overturn the 2020 election, despite his wife Ginni Thomas’s active role in promoting such efforts.
Pattern of Ethical Misconduct:
-Over two decades, Thomas has accepted undisclosed vacations and gifts from wealthy benefactors, creating a consistent pattern of ethical lapses that undermines public confidence in the Court.
Justice Samuel Alito:
Undisclosed Gifts:
Justice Alito accepted an all-expenses-paid luxury fishing trip with billionaire Paul Singer, whose business interests were later involved in cases before the Supreme Court. Alito did not disclose this trip or recuse himself from these cases, violating federal disclosure laws and ethical standards.
Conflicts of Interest:
Alito’s refusal to recuse himself from cases involving Singer’s interests demonstrates a disregard for judicial impartiality and creates an appearance of bias prohibited under judicial ethics codes.
Additional Ethical Concerns:
Flags associated with pro-Trump activists were displayed at Alito’s residence during cases related to January 6th events. While Alito attributed this to his wife’s preferences, it raises questions about his impartiality in politically charged cases.
Legal Basis for Impeachment:
-Article III’s "Good Behavior Clause" allows for the removal of federal judges who fail to uphold ethical standards.
-Precedent exists for impeaching judges for ethical violations. For example, Judge Walter Nixon was impeached in 1989 for perjury, demonstrating that ethical misconduct is grounds for removal.
-Justices are bound by 5 U.S.C. §§ 7351 and 7353, which prohibit accepting gifts that could influence their judgment or create conflicts of interest.
Supporting Evidence:
-The Senate Judiciary Committee’s December 2024 report revealed extensive evidence of undisclosed gifts and conflicts of interest involving both justices.
-ProPublica investigations uncovered decades-long patterns of undisclosed financial benefits received by Justice Thomas from Harlan Crow.
-Public trust in the Supreme Court is at a historic low due to these ethical controversies.
Call to Action:
We urge Congress to act decisively by investigating these allegations through the House Judiciary Committee and drafting articles of impeachment if warranted. Failure to address these ethical violations risks further erosion of public trust in our nation’s highest court.
