Petition for Resentencing Hearing of Javier Martinez

The Issue

Senate Bill 6164, which went into effect in 2020 in the state of Washington, gives an incarcerated individual the opportunity to submit to the prosecutor
of his/her county of origin a request for a resentencing hearing.

The Bill was designed to give prosecutors the discretion to petition
the court to resentence an individual, if the person's sentence no longer
advances the interest of justice. 

What does it mean, "no longer advances the interest of justice?" The purpose of sentencing is to advance public safety through punishment, rehabilitation, and restorative justice. When an individual can demonstrate he's met or exceeded this criteria set forth in the bill, his sentence then no longer advances the interest of justice.

How can I demonstrate to the prosecutor that I qualify under SB6164 for a resentencing hearing and should be given a second chance?

I've done everything I can to better myself. For more than 20 years I have, either as a participant or a facilitator, gotten involved in numerous volunteer/self-help programs.  As well as completing vocational courses.  These programs and courses have equipped me with the tools that will help me not only become a productive member of society but also to become a successful one.  

Everything that I've done to better myself is because of my faith in God.  The good Lord gave me the strength when I needed it most to walk away from the gang life 20 years ago. I put all my trust in Him then and continue to serve the Lord faithfully.  This decision to turn my life around allowed me to grow and become the individual I am today.  I am able to use what I have done to help others who are going through the same trials and tribulations I once faced. 

I know without a doubt that if I am given a second chance at an early release, I will take this experience of being incarcerated since I was a teenager and use it to become a better mentor for the youth of the community I am released to. 

I was sentenced to 56 years. Having been locked up for 29 years, I have served more than half my sentence. I was 19 years old when I made the worse decision of my life. One I will always live with. I realize there are consequences for my actions. I also feel that people do deserve a second chance. 

Should you decide to sign this petition, it will be your way of showing the prosecutor your support in my attempt for a resentencing hearing. One that could result in me being resentenced to lesser time or given credit for time served and being released. The Lord knows we are all praying for the latter.

Your signature also shows your support of my release and if given the opportunity, I can be a productive member of society. Most importantly, in signing this petition, you're saying my sentence no longer advances the interest of justice.
