We’ve reached a significant milestone today — over 3,000 signatures on our petition advocating for a retrial in the case of Terrence Cumber. This incredible support is a powerful reminder of the importance of fairness, due process, and justice in our legal system.

Terrence Cumber’s conviction for felony murder in the tragic death of Ahmad Popal has raised serious questions about the fairness of the trial and the accuracy with which the facts were presented. Terrence was sentenced to life in prison with the possibility of parole, plus 5 years for the firearm charge. However, we believe the conviction was based on an incomplete understanding of the facts and a misapplication of the law. The tragic incident occurred outside a nightclub in 2020 following a violent altercation. Terrence, who had been assaulted, sought to remove himself from the situation. However, he was followed, and after witnessing his brother being attacked, he made a split-second decision to defend himself and his loved ones. The shooting was an immediate reaction—there was no time for deliberation or premeditation. Terrence did not intend to kill anyone. This is why it’s critical to highlight that while Terrence was acquitted of malice murder, meaning the jury did not believe he intended to kill Ahmad, he was still convicted of felony murder—a charge that doesn’t fit the circumstances. Felony murder is a charge typically associated with premeditated violence, not an impulsive response to an ongoing altercation. We strongly believe that this conviction was both unjust and disproportionate, and a retrial is necessary to fully consider all the facts and circumstances surrounding the incident. The shooting was a reactionary act driven by a need to protect himself and others, not premeditated murder. Terrence was placed in a position where he felt his life and his brother’s life were in imminent danger. This context was not fully explored during the trial. The jury should have been given a clearer understanding of all potential charges, allowing them to make a more informed decision on how to assess the circumstances.
We have received numerous messages and comments, and we are humbled by the widespread support. Many of you have pointed out that the severity of the life sentence does not fit the situation. A life sentence for someone who acted in the heat of the moment, with no intent to kill, simply doesn’t match the nature of this incident.

Your support has been incredible. When we first launched this petition, we never anticipated the overwhelming number of signatures, comments, and messages of support we would receive. Every signature means a step closer to securing the justice Terrence deserves. You’ve shared similar stories and asked questions that cut to the heart of the case. We hear you. We know this isn’t just about one person—it’s about ensuring justice is served fairly for everyone.

Many of you have pointed out similar cases where individuals in similar situations were not charged with felony murder, or where the charges were dropped entirely. This inconsistency points to a deeper problem with how self-defense is treated within the legal system. Terrence’s case, while unique in its own right, is indicative of a broader need for reform—to ensure that the law is applied fairly, consistently, and without bias.

As one commenter put it:

“If they take away his right to defend himself, they can take yours too.”
The real concern here is not just about one man’s fight for justice, but about how this case reflects broader issues in how self-defense is handled in our legal system. We cannot allow people to be punished for defending themselves.

We also want to take a moment to share a personal message from Terrence’s brother, who was there the night of the incident:

"We didn’t want to fight. We didn’t want for violence to happen. We were provoked numerous times before the shot went off. WE TRIED TO DE-ESCALATE THE SITUATION BY GOING HOME. What sense does it make if the woman HE WAS WITH, even said he just asked ONE question to her and dude got mad. WE HAD TWO DIFFERENT ENCOUNTERS INSIDE THE CLUB THAT HE WAS THE AGGRESSOR AND EVEN THE LEAD INVESTIGATOR SAID HE WAS. Yall must’ve forgotten if he would have let us go home that everyone would have made it home safe that night????" These words are heartbreaking, but they’re an important reminder that this wasn’t a case of cold-blooded murder—it was a tragic moment of chaos and fear. Terrence’s actions were rooted in the instinct to protect, not to harm.
