Petition: Equal Legal Age for Voting, Marriage, and Criminal Responsibility in India

The Issue

The Government of India, Ministry of Law and Justice

Subject:

Removal of Contradictions in Legal Age for Adulthood – Either Set All at 18 or All at 21

Petition Summary:

We, the citizens of India, demand a uniform legal age for adulthood across all aspects of life—voting, marriage, and criminal responsibility. Currently, Indian laws are inconsistent and unfair:

A person can vote at 18, deciding the country’s future.

A person is tried as an adult in criminal cases at 18.

A person can sign contracts and run a business at 18.

A person can join the army and risk their life at 18.

But a man cannot marry before 21, while a woman can marry at 18.

This double standard is illogical, discriminatory, and unconstitutional. We demand that either:

1. All adulthood rights, including marriage, start at 18.

2. Or all adulthood rights, including voting and criminal liability, start at 21.

Detailed Analysis: Why This Law Must Change?

1. Contradiction in Legal Definitions of Adulthood

If 18 is the legal age of adulthood, then a person is mature enough to vote, sign contracts, work, and serve in the army. There is no reason why they should not be allowed to marry. If 21 is considered the right age for marriage, then voting, army service, and criminal responsibility should also begin at 21. The law cannot selectively define adulthood.

2. Gender Discrimination in Marriage Laws

Marriage laws allow women to marry at 18, but men must wait until 21. This is a clear violation of gender equality under the Indian Constitution. Either both should be allowed to marry at 18, or both should wait until 21.

3. Economic and Social Consequences of Delayed Marriage for Men

A man at 18 is legally expected to work, pay taxes, and contribute to society, but he is denied the right to marry. Delayed marriage leads to delayed family planning, affecting demographic balance. Countries with lower marriage ages have stronger family structures and lower crime rates. Allowing marriage at 18 would encourage financial responsibility and social stability.

4. Impact on Crime and Misuse of Laws

Sexual relationships often begin before 21. If an 18-year-old boy is in a consensual relationship with an 18-year-old girl, but her parents object, he can be falsely accused under strict laws. This law is frequently misused to target young men unfairly. Recognizing 18-year-olds as adults in all aspects would prevent such injustices.

5. No Scientific Basis for This Age Gap

there is no scientific study proving that men need three extra years of maturity for marriage compared to women. Countries like the USA, UK, Russia, China, Japan, and most of Europe allow marriage at 18 for both genders. India should follow global standards.

Our Demands (Choose One Standard for Adulthood)

We demand the Indian government to remove contradictions in adulthood laws by either:

1. Making 18 the legal age for everything (Voting, Marriage, Criminal Responsibility).

2. Making 21 the legal age for everything (No voting, military service, or criminal responsibility before 21).

If an 18-year-old is responsible enough to vote and join the army, they should also be responsible enough to marry. If they are too young to marry, they are too young to vote or be held criminally accountable as adults.

Call to Action

We urge the Government of India to amend the law and ensure a uniform adulthood age. This will bring legal consistency, gender equality, and social stability.

This petition represents the voice of the people demanding fairness in legal definitions of

adulthood. We request immediate legislative action to rectify this inconsistency.
