REQUEST CALLING FOR EXTRAORDINARY GENERAL MEETING (EGM) ONLINE FORM BY INDEPENDENT UNIT

The Issue

We are the owners (Proprietors) of Parc Regency Serviced Apartment (Residensi Masai), located in Jalan Masai Jaya 2, Pletong. We ask the help of THE MBJB COMMISSIONER OF BUILDING (COB) to instruct the JMB COMMITTEE to have the 'EXTRAORDINARY GENERAL MEETING' (EGM) online as soon as possible and to be conducted by an Independent 3rd Party EGM Organizer for the following reasons:

  1. The last AGM was held on 19th December 2019, which has been more than a year and 6 months that our community didn't hold an any General Meeting for proprietors to discuss matters of apartment. For the past AGM hold, there is manipulation of voting because the committee members, management office, AGM organizer, vote counting agents are all related parties to the Developer (i.e. subsidiaries company & employees).
  2. All the committee members and the managing agent (Management Company) are related to the developer. Therefore, the committee members and management company are making monetary decision on favourable to the developer. They are not concern about the residents who lived in the Apartment.
  3. JMB awarded a building management contract to a subsidiary of the developer, MMS Sdn Bhd (Management Company) at a very high price since 2016. This has abused JMB's power and there are elements of conflict of interest" in addition to violating "SMA 2013 (Act 757) & Regulations"
  4. JMB violated the Section 21(1) of Strata Management Act 2013 (Act 757 of Law of Malaysia), for not performed its duties of joint management body for:
    1. Subsection 21(1)(a) properly maintain and manage the building; 
    2. Subsection 21(1)(c) determine the contribution of sinking fund account for the purpose under subsection 24(2); 
    3. Subsection 21(1)(f) maintain a register of all parcel owners of the buildings for subdivision into parcels.

We request an independent organizer (such as GFM GROUP SDN BHD, click for Company Background) to conduct the EGM to ensure the followings:

  1. Fair and impartial to all the proprietor's voting rights, no biased to the individual proprietors or the unsold units of developer
  2. Transparency of voting validity and vote counting process
  3. Rights of proprietors to ask questions during the General Meeting
  4. Efficiency of following up with Managing Agent (Management Company) for the unmatched bank account balance and financial account.
