Pass the Rebecca Park Act in Michigan. Protecting survivors from abuse from former parent

The Issue

My name is Christina Castaneda, and I am a survivor of childhood abuse. My biological mother lost her parental rights to me in 1989 because of the abuse I experienced. Decades later, she has resurfaced and has repeatedly harassed me, interfered with my life, and used fraudulent tactics to cause harm.

When I saw the heartbreaking murder of Rebecca Parks in Boon Township, a young pregnant woman killed by a mother who had previously lost parental rights, I realized that survivors like us have almost no legal protection in Michigan from abusive former parents. This tragedy underscores a critical legal gap that needs to be addressed urgently to protect adult survivors.

Currently, Michigan lacks adequate legal measures to protect adult survivors of childhood abuse from their former parents. Domestic violence protections often don't apply when the abuser is no longer your legal parent, leaving survivors vulnerable and without legal recourse. The Rebecca Parks Act is essential to fill this void and offer much-needed protection. This Act would establish protective orders and restrictions against former parents who have a history of abuse and have lost parental rights, preventing them from causing further harm or intimidation.

According to the National Coalition Against Domestic Violence, 1 in 4 women and 1 in 9 men experience severe intimate partner physical violence, which often stems from childhood abuse histories. The impact of abusive parents can continue to affect survivors well into adulthood, manifesting in emotional distress, strained interpersonal relationships, and even violence. Instituting legal safeguards for adult survivors is a vital step towards breaking this cycle and ensuring that past abusers cannot re-enter and disrupt lives.

Passing the Rebecca Parks Act would empower survivors to reclaim control over their lives without the fear of harassment or retaliation from the very individuals who oppressed them during their most vulnerable years. This legislation would not only offer a shield for survivors but also honor Rebecca Parks' legacy by preventing further losses of life and dignity among survivors.

I urge Michigan lawmakers to prioritize our safety and well-being by enacting this critical piece of legislation. Survivors deserve peace and security.
