

Pass the Modernizing Child Protection in the AI Era Act: Close the AI Exploitation Loopho
The Issue
Every child in America deserves to be protected from digital abuse, exploitation, and harm.
My name is Valentina M. Hansen. As a retired federal law enforcement officer, a healthcare professional with over 20 years of experience, and a woman of faith, I have spent my life standing up for public safety and the vulnerable. Today, our children face an urgent crisis, and our federal laws are failing to protect them.
In a recent federal court decision (United States v. Steven Anderegg), an appellate court ruled that possessing hyper-realistic, artificial intelligence-generated child sexual abuse material in the privacy of one’s home is protected under the First Amendment, relying on legacy Supreme Court precedents (Stanley v. Georgia and Ashcroft v. Free Speech Coalition).
The federal judges explicitly admitted that modern AI renders images "virtually indistinguishable from those depicting the abuse of actual children." Yet, because existing federal statutes were written decades before generative AI existed, the courts concluded they lack the authority to close this loophole without Congressional action.
Synthetic abuse material is NOT a victimless technicality:
Drives Real-World Physical Harm: Criminological and psychological research proves that consuming abusive imagery—or engaging in cruelty toward animals—desensitizes perpetrators, validates pedophilic fantasies, and statistically increases the likelihood of physical contact offenses against children.
Obstructs Law Enforcement: Hyper-realistic synthetic media floods digital networks, severely impairing federal law enforcement officers from distinguishing synthetic renderings from real children and rescuing active victims in time.
OUR CALL TO ACTION:
I have officially compiled and submitted a comprehensive, turnkey legislative package—the Modernizing Child Protection in the AI Era Act of 2026—to First Lady Melania Trump to leverage her Be Best platform, as well as to Congressional leadership and our Texas representatives.
This bill amends Title 18, U.S. Code (§§ 2252A and 2256) to:
Explicitly criminalize the generation, production, distribution, and possession of AI-generated and synthetic child sexual abuse material.
Define "indistinguishable" material so that visual depictions portraying a minor in explicit conduct are illegal regardless of how they were created.
Eliminate the "virtual minor" and private residence defenses for synthetic abusive media.
