Pass Gwen’s Law in Texas: Hold Negligent Owners of Microchipped Animals Accountable

Why This Petition Matters

In Texas, most microchips come from shelters during free or low-cost adoption events. Dogs get adopted already microchipped, and the new owner’s name becomes the information on file. When that adopter neglects, abandons, or mistreats the animal, there is still no accountability tied to the microchip. Gwen’s story brought this issue to light, and she inspired this petition to change that.

Gwen’s Story

Gwen was a microchipped dog in Texas whose body told the truth: she had endured long-term neglect, untreated illness, and preventable suffering. Even though she had a registered owner, no accountability existed for the condition she was found in, because Texas law does not tie legal responsibility to the microchip registration.

Her story is not rare.

Every day in Texas, shelters, rescues, veterinarians, and animal control encounter microchipped animals who are:

  • starving
  • severely ill
  • infected
  • dehydrated
  • abandoned
  • suffering from chronic untreated conditions

Under current Texas law, a microchip does not legally assign responsibility, even though it clearly identifies the last known owner.

An owner can neglect or abandon their animal and face no consequences, even when the microchip proves the animal belonged to them.

Gwen’s Law closes this dangerous loophole.

What is Gwen’s Law?

Gwen’s Law is a proposed piece of Texas legislation that would:

1. Hold microchipped animal owners accountable

If a microchipped dog or cat is found neglected, the person listed on the microchip is legally responsible unless they provide proof of a legitimate transfer.

2. Require mandatory welfare investigations

When a microchipped animal shows clear signs of neglect - starvation, untreated illness, organ decline, infection, or abandonment - vets, shelters, and rescues must report it and trigger an official investigation.

3. Establish criminal penalties for neglect

  • Basic Neglect: Fines and mandatory education
  • Severe Neglect: Class A misdemeanor, up to 1 year in jail, fines up to $4,000, and a 5-year ban on animal ownership
  • Abandonment / Gross Neglect: State jail felony, 6 months–2 years jail, up to $10,000 fine, and a lifetime animal-ownership ban

4. Require owners to update microchip info within 7 days

If someone gives away or sells a pet but never updates the microchip, they remain legally responsible. This closes the common loophole where owners avoid responsibility by claiming the animal was ‘rehomed’ without providing proof.

5. Owners Must Report Microchipped Pets Missing

Owners of microchipped pets must report their pet missing within 72 hours to animal control or a local shelter and update the microchip registry.

If they fail to report the animal missing, they cannot claim the pet “ran away” to avoid responsibility when the pet is later found neglected, sick, or severely harmed.

This prevents owners from escaping accountability by pretending the animal was “missing for a long time.”

Why this law will save lives

Microchips were created to protect animals. But without accountability, they protect no one.

Gwen’s Law ensures:

  • no microchipped animal falls into silent neglect again
  • shelters and vets have clear reporting procedures
  • law enforcement knows who is responsible
  • owners cannot hide behind “I rehomed them” without proof

Most importantly: neglected animals finally have legal protection that matches their vulnerability.
