Parental Rights In Special Education

The Issue

As a parent of a child in an autism classroom, I have experienced firsthand the stress and concern of having my son's educational environment changed without my consent. My son's school has attempted to transfer him to a different autism classroom in another school, insisting that this alteration does not require an Individualized Education Program (IEP) meeting or parental involvement. This is because they view the matter as a mere change of location and not as a significant shift in placement. The disregard for our opinion and participation appalled me. 


This is both unsettling and alarmingly short-sighted. Parents have the right, and a duty, to be actively involved in decisions that impact their children's education. Decisions regarding school location, classroom setting, transportation, and related services can deeply affect a child's learning progress, especially for children with special needs. The Individuals with Disabilities Education Act (IDEA) defines placement as the provision of special education and related services, indicating that changes in location do directly relate to changes in placement (US Department of Education, 2000).

This silence and exclusion of parental opinions on issues that substantially affect our children's education, safety, and well-being are devastating. Parents must be included in decisions involving any changes affecting our children. Therefore, we demand that parental involvement be mandated in all such decisions at all times, whoever the child might be or what their circumstances may be.

Our children deserve better. National Dissemination Center for Children with Disabilities relates that research supports the importance of parental involvement in an IEP process as it leads to improved educational services and outcomes for students. Parents are vital advocates for their individual child's needs, including any changes involving school location, placement, transportation, and related services. 

So I ask this, as a parent, grandparent, aunt, uncle, brother, sister…if you received a letter that was dated 21 days prior to the start of the school that they were expecting our children to attend, and that letter was not asking, but TELLING you that your child—-a child who can’t communicate on his own, who’s already suffered emotional distress related to school, resulting in drastic personality changes and physical symptoms, who is only 6 years old, and has already been in 4 different classes at 2 different schools in less than 10 months, who has just finally started to settle into his current location and feel safe—-will be being moved to another classroom located at a different school, with different peers, ages, staff, etc. and that the decision was made without you and that because of legal definition of the word “placement” described under the law—they DO NOT NEED your consent and that you have NO right to be involved in the decision at all. That it is a “district decision” made in the best interest of your child by those who do not know anything about your child, what they have experienced, or the kind of trauma that a change like this will cause to your child or the hardship it will place on your family.——-please, tell me how you would feel, how you would react, and what you would do? Because I believe that every one of you would be right here beside me fighting it as well.


This petition hence pleads with education authorities to make it mandatory for parents to have the ability participate in all changes concerning their children's school location, placement, and services. Our children's educational environment must not change without our knowledge, input, and agreement.
