Stop the City of Palestine, Stop the State of Texas & Stop the Federal Government

The Issue

Lawnmower Man, Jerry Laza, has an Appeal that has been PAID for of the Judgement and Injunction of the City of Palestine vs. Jerry Laza waiting to be heard and the Bankruptcy Court is selling it back to City of Palestine.  The word is the amount is in the six figures but the total will not be made public.  It is being talked about behind closed doors.

This was a "land grab" from the very beginning.  Backed by "behind the scenes manipulators", City Attorney Ron Stutes filed a lawsuit unbeknownst or approved by the City Council. Once they were made aware, they didn't approve it officially, but they didn't stop it. When it went to Court the Judge wouldn't listen to the Texas State Law that says it needs Council Approval, so he didn't stop it. Laza's defenses were blocked by the Judge so the Jury didn't get to hear how it was unauthorized & Laza has a permit for outside storage & had already been to Court with a favorable ruling, giving him vested property rights. Even though he was overruled in District Court he was able to battle his way to an Appeal.

Unable to put up a cash bond of $164,000 to "stay" the District Court & Ron from pushing & enforcing the Injunction incarcerating Laza for 7 days & confiscation his belongs he was forced to seek the protection of the Bankruptcy Court.

Now the City is being allowed to buy the Civil Rights Case and an Appeal back from the Bankruptcy Court when they caused the bankruptcy in the first place.

Part of the problem is that Jerry Laza has never been a "real" person to the Court system or Lawyers.  If you know him or if you are a loyal customer please let them know. Or if you are someone that still believes that the Bill of Rights and the Constitution still is worth fighting for.

Please let the decision makers know that you don't agree and that you think this case should stop and Laza should be allowed to have his day in Court.  What would that hurt?

While you may not think this applies to you.  Texas Municipal League/Texas City Attorney Association is teaching this lawsuit as a continuing education class to other municipal attorneys.

Here in a nutshell, the Bankruptcy Trustee is allowing the City to make an offer to buy their way out of a gross abuse of and individual Civil Rights. Summing up the facts is Jerry Laza a tax paying citizen and you, a tax paying citizen, have helped fund the City of Palestine’s (Government) pursuit to grossly violate his rights to due process, an unreasonable search and seizure,  to speedy trial, confront an accuser (the City paid a witness to leave town and not testify), double jeopardy or res adjudicata (no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law), excessive fines (they used the State Code, City structure does not allow the fine structure used) and individual private property rights.
