The Issue

Petition to Dispute Proposed Land Use Amendment (Rural to Residential/Condominium) & Land development in the South phase (York River) and any future developments in this pristine area (North Phase & South Phase)

We, the undersigned residents and stakeholders of Dysart et al hereby submit this petition in formal opposition to the proposed amendment of land use designation from rural/agricultural to residential/condominium development for the property located at for lot 27 Concessions 10 & 11 in Harcourt Township:

The application for the south phase is situated along the York River, not Elephant Lake. It’s important to note that the York River flows directly into the connected waterway system of Benoir Lake and Elephant Lake, eventually leading to Baptiste Lake. This makes it part of a continuous and highly trafficked waterway.

Benoir Lake, in particular, contains key amenities including a marina with a boat launch, gas bar, and a small convenience store. As a result, it serves as a central access point for boaters in the area.

However, Benoir Lake is already heavily populated and experiences significant recreational boat traffic. Introducing additional boats from the proposed development will undoubtedly increase usage of the marina and surrounding waterways, intensifying environmental and safety pressures. This level of increased activity is likely to have a negative impact on the ecological balance of the lake and the quality of life for current residents and users.

This proposed amendment raises several significant concerns which we believe warrant a thorough review and reconsideration.

1. Environmental Impact

The area in question serves as a critical part of the local ecosystem, supporting native flora and fauna. Transitioning to high-density residential use would:

• Increase pollution (air, water, and noise)

• Disrupt wildlife habitats (turtles, frogs, blue herons, turtles, bears, wolves, etc.,)

• Overburden existing drainage and water systems & destroying Wetlands


2. Infrastructure Limitations

The current infrastructure—including roads, sewage, and water supply—is not designed to accommodate the increased demand that a condominium complex would impose. This raises concerns about:

• Traffic congestion and safety
• Inadequate water pressure and supply
• Overstretched emergency services (fire, medical, police)
3. Community Character and Heritage

This region has historically been zoned as rural, with agricultural roots and a close-knit community identity. A sudden shift to residential/condominium use:

• Alters the cultural and historical character of the area
• Sets a precedent for further urban encroachment
4. Lack of Transparent Public Consultation

We believe the public consultation process thus far has been insufficient, with limited notice and minimal engagement. We request:

• A public hearing accessible to all affected residents
• A full disclosure of development plans (as stated on website 
• A postponement of any approval until adequate consultation is completed
 

In Conclusion

We respectfully urge to reject the proposed amendment and development in the south phase.
