Oppose rezoning request for unauthorized property modifications

The Issue

The Mission San Jose Neighborhood Association is joining in opposition to the rezoning request by Joel's Collision body and paint shop for his property where unauthorized modifications have been made. The applicant has proceeded with significant additions to the existing building without the necessary building permits, inspections, or approvals from the Historic and Design Review Commission (HDRC). These actions violate established regulations designed to ensure safe and community-approved development. 

It is essential to hold property developers accountable to prevent unchecked and potentially unsafe expansions that could impact the environment and character of our cherished neighborhood. The applicant's decision to repurpose the structure as a paint and body shop raises additional concerns about potential environmental hazards and disruption to our community's tranquil atmosphere.

The HDRC is tasked with preserving the historical and cultural fabric of our area, and circumventing their authority erodes our community's collective voice and trust in the planning process. Such disregard for the rules that safeguard our neighborhood integrity should not be permitted. Allowing this rezoning would set a dangerous precedent that undermines the very foundations of community planning and engagement.

We urge the city council and relevant authorities to deny this rezoning request, ensuring that all neighborhood modifications are undertaken legally, safely, and transparently.
