New Jersey Assembly Bill No. 2586 (Senate Bill No. 1534) would exempt private colleges and universities from any kind of municipal land use oversight and from requirements for compliance with local zoning codes under the Municipal Land Use Law, eliminate the kind of careful review that municipal planning boards and boards of zoning adjustment conduct when evaluating land use applications, and cause more, rather than less, conflict between private universities and the municipalities in which they are located.

The Senate version of this bill passed 26-8-6 on June 28, 2012.  The Assembly Bill No. 2586 has been referred to the Assembly Higher Education Committee.  Along with signing this petition, you can contact members of this committee below:

I just signed the following petition addressed to the Assembly Higher Education Committee, the members of the New Jersey General Assembly, and the Governor of the State of New Jersey.

Oppose Assembly Bill No. 2586 (Senate Bill No. 1534)
Exempting Private Colleges & Universities from Local Land Use Agency Review

The New Jersey Legislature is considering legislation that would exempt New Jersey’s private colleges and universities from the requirements provided by NJSA 40:55D, specifically the “Municipal Land Use Law.” S-1534 passed the Senate on June 28. Now A-2586 awaits consideration by the Assembly Higher Education Committee.

We call on members of the New Jersey Legislature to oppose this bill, which undermines the role and voice of citizens and taxpayers in the future of their own towns.

We recognize the benefit to a community hosting an institution of higher education. The “town-gown” partnership between a municipality and a college or university within it is vital to all stakeholders. However, this partnership must be a balanced one. Private colleges and universities absolutely should not be exempt from the public land use vetting process that currently serves all stakeholders. The public process is essential to the planning process, and should not be diminished or hindered in any way.

A-2586 would establish a very troublesome precedent for communities across the State. This legislation could be the springboard for other special interests, which receive public funding, including privately-owned charter schools, non-profits, and non-governmental organizations, to seek the same special status of exemption from the requirements of NJSA 40:55 – namely, the “Municipal Land Use Law.”

We are encouraged that a wide range of interested parties oppose A-2586/S-1534, including the New Jersey State League of Municipalities, the American Planning Association-New Jersey Chapter, and the majority of the Mayors of the communities adversely impacted by this legislation. We join them in firm opposition to A-2586/S-1534.

As concerned residents of New Jersey, we call on the members of the Assembly Higher Education Committee, the members of the New Jersey General Assembly, and the Governor of the State of New Jersey to oppose A-2586/S-1534.
