بیانیه وکالت حقوقی در حمایت از آزادی‌های بنیادین بشر

ما، امضاکنندگان این سند، با استناد به اصول مندرج در اعلامیه جهانی حقوق بشر (مصوب ۱۹۴۸)، میثاق بین‌المللی حقوق مدنی و سیاسی (ICCPR)، و سایر اسناد معتبر حقوق بشری بین‌المللی، بدین‌وسیله به بنیاد بنی (Bani Foundation) وکالت رسمی، غیرقابل فسخ و قانونی اعطا می‌نماییم تا به نمایندگی از ما در مجامع حقوقی، قضایی و بین‌المللی، از حقوق بنیادین و غیرقابل سلب ما در زمینه‌های زیر دفاع و حمایت نماید:

۱. حق آزادی اندیشه، وجدان و مذهب (ماده ۱۸ اعلامیه جهانی حقوق بشر و میثاق ICCPR)
۲. حق آزادی بیان و ابراز عقیده (ماده ۱۹ اعلامیه جهانی حقوق بشر و میثاق ICCPR)
۳. حق مشارکت در زندگی فرهنگی، دینی و معنوی بدون ترس از آزار، تبعیض یا تعقیب

این وکالت شامل دفاع حقوقی و علنی از اعضای بنیاد بنی، و همچنین استاد محترم جناب آقای کمال الماسی جاف (معروف به "کاتب")، در برابر هرگونه اقدام مغایر با اصول حقوق بشر، اعم از فشار، محدودیت، تهدید یا سایر اشکال نقض حقوق، می‌باشد.

ما همچنین از کلیه نهادها و سازمان‌های بین‌المللی مدافع حقوق بشر درخواست رسیدگی، مداخله و اتخاذ تدابیر مؤثر برای صیانت از این حقوق اساسی را داریم و آمادگی داریم از تمامی ابزارهای مشروع حقوقی و بین‌المللی در این راستا استفاده نماییم.

این بیانیه با حسن نیت و بر پایه اراده آزاد تنظیم گردیده و نزد نهادهای ذی‌صلاح قابل استناد است.

Statement of Legal Representation in Support of Fundamental Human Freedoms

We, the undersigned, hereby grant the Bani Foundation full, irrevocable, and lawful power of attorney to represent us in legal, judicial, and international forums in defense and protection of our inalienable and fundamental rights, as enshrined in the Universal Declaration of Human Rights (adopted in 1948), the International Covenant on Civil and Political Rights (ICCPR), and other recognized international human rights instruments. These rights include:

1. The right to freedom of thought, conscience, and religion (Article 18 of the UDHR and ICCPR)

2. The right to freedom of expression and opinion (Article 19 of the UDHR and ICCPR)

3. The right to participate in cultural, religious, and spiritual life without fear of persecution, discrimination, or harassment

 

This power of attorney also encompasses legal and public advocacy in defense of members of the Bani Foundation, including the esteemed Mr. Kamal Almasi Jaf (known as “Kateb”), against any actions in violation of human rights principles, including but not limited to coercion, restrictions, threats, or other forms of rights violations.

We further call upon all international human rights bodies and organizations to investigate, intervene, and take effective measures to protect these fundamental rights. We affirm our readiness to utilize all legitimate legal and international means in this pursuit.

This statement is made in good faith and of our own free will, and shall be considered valid and admissible before competent authorities.
