Earlier Sunday morning, Bleacher Report’s Mike Freeman reported that Colin Kaepernick filed a grievance against the owners for — as we knew all along — “collusion” under the CBA. (Which is the collective bargaining agreement between the players & owners). The filing was confirmed by ABC News.
According to a source with knowledge of the situation: Kaep’s end goal is to “terminate the current Collective Barganing Agreement”, since Article 69, Section 2 & Article 17, Section 16(c) of the CBA states that “only one incident” involving collusion with only one player can trigger an “early termination” of the agreement.
Kaepernick has hired famed attorney Mark Geragos, who previous represented Michael Jackson, Chris Brown and others.
Here’s Geragos statement, on behalf of Kaepernick:
"If the NFL (as well as all professional sports teams) is to remain a meritocracy, then principled and peaceful protest -- which the owners themselves made great theater imitating weeks ago -- should not be punished and athletes should not be denied employment based on partisan political provocation by the Executive Branch of our government.
"Such a precedent threatens all patriotic Americans and harkens back to our darkest days as a nation. Protecting all athletes from such collusive conduct is what compelled Mr. Kaepernick to file his grievance.
"Colin Kaepernick's goal has always been, and remains, to simply be treated fairly by the league he performed at the highest level for and to return to the football playing field.”
It’s a shame it had to get this far, but in connection to all civil rights fights in the past, this filing HAD to be done.
Our prediction: This will ultimately reach the U.S. Supreme Court, as the final ruling will be a landmark case and mark a turning point if players/employees can take a knee (or show any patriotic gesture) without getting fired or disciplined from their employer.
There’s also the meeting that will take place on Tues & Wednesday Oct 17 & 18 between the Owners and the NFL Players Associaltion to determine if a rule will come out forcing players to stand for the Anthem.
We’re witnessing history right before our very eyes.
