Hello Palm Coast Supporters!

First and foremost, welcome new supporters!  We appreciate your support and please know we are working hard behind the scenes to stop these flight schools!  We also want to thank our volunteers!  They have been getting the flyers out and we appreciate that!  We could not be making any progress without you!

These planes have been flying dangerously low over our homes!  They are not supposed to be below 500 feet when 'taking off and landing'.  They can only go below 500 feet WHEN NECESSARY.  They cross this line daily!  This is a violation of 14 CFR 91.119 and 91.13.  See complaint below.

It's better if you have a screenshot of the aircraft, but a simple complaint such as, "they're too low over Zebulah's Trail right now!" will suffice.  Hopefully, we can look up the plane for further evidence.

COMPLAINT SENT TODAY:

Dear Flagler County, Flagler Executive Airport, FAA Orlando Flight Standards District Office (FSDO-15), and Others,

I am filing this formal complaint regarding apparent safety concerns from two separate low-altitude flight operations observed over residential neighborhoods in Palm Coast, Florida (near Gore Lake, Belle Terre Boulevard, Ziegler's Place/Court, Zonal Court, Zinna Place, and adjacent trails/woods), on **March 19, 2026**.


These appear to be flight training activities (likely touch-and-go or practice maneuvers) associated with **Flagler Executive Airport (KFIN)**:


1. **Diamond DA42 Guardian, Registration N316ER** (operated by Embry-Riddle Aeronautical University, Inc.):
   - Timeframe: Approximately 08:41–08:58 local time.
   - ADS-B track data shows multiple low passes at altitudes as low as **50 ft AGL**, with frequent points at **100–175 ft** and up to **525 ft**, directly over or adjacent to homes, trails, and residential streets (e.g., Ziegler's Court, Zonal Court, Zinna Place).
   - Examples: 08:47:32 – 89 kt at 50 ft; 08:47:07 – 117 kt at 350 ft; multiple at 100–175 ft.


2. **1968 Cessna 172 Skyhawk, Registration N78647** (operated by TWJ Aviation 1 LLC):
   - Timeframe: Approximately 09:11–09:12 local time.
   - ADS-B track shows sustained extremely low flight along/near Belle Terre Boulevard, with altitudes as low as **0 ft** and **25 ft AGL**, plus points at **125–175 ft**.
   - Examples: 09:12:18 – 56 kt at 0 ft; 09:12:14 – 64 kt at 25 ft; 09:12:09 – 74 kt at 25 ft.


While I recognize these may involve training maneuvers or approaches/landings at KFIN, the observed altitudes — particularly the near-ground levels (0–50 ft AGL) and sustained low flight over populated residential areas with homes, streets, and likely people — appear to fall well below safe minimums and raise serious hazards.


Relevant FAA regulations include:


- **14 CFR § 91.119** (Minimum safe altitudes): Except when **necessary** for takeoff or landing,
  - Over congested areas (residential neighborhoods): 1,000 feet above the highest obstacle within a 2,000-foot radius.
  - Anywhere: An altitude allowing a safe emergency landing without undue hazard to persons or property on the surface.
  The tracks do not clearly show standard traffic pattern alignments or short-final approaches to KFIN runways; instead, they depict straight/low paths parallel to residential boulevards and over non-airport property.


- **14 CFR § 91.13(a)** (Careless or reckless operation): No person may operate an aircraft in a careless or reckless manner so as to endanger the life or property of another. Extremely low sustained altitudes over homes create imminent risks (e.g., engine failure, loss of control, or prop strike could endanger residents and property with little/no margin for safe recovery).


I have attached screenshots from globe.adsbexchange.com showing the ADS-B tracks, timestamps, speeds, altitudes, registrations, aircraft types, and operators. This data is publicly verifiable and provides objective evidence.


These incidents align with ongoing community concerns about low overflights from flight training at KFIN (including voluntary "Fly Friendly" noise abatement guidelines that recommend higher patterns, delayed turns over non-residential/wooded areas, and avoidance of neighborhoods — often not followed). While noise is a related issue, my primary concern here is **safety** due to the extraordinarily low altitudes documented.


Please investigate these operations thoroughly, including:
- Review of ATC records, pilot/operator statements, and flight logs.
- Determination of whether the altitudes were strictly necessary for takeoff/landing or standard training patterns.
- Assessment of compliance with §§ 91.119 and 91.13.
- Any patterns of similar low-altitude activity by these operators or at KFIN.
