At yesterday's monthly RHCCC meeting, I shared updates on PHCPA's progress on opposing the proposed data center at Puente Hills Mall and our CEQA lawsuit demanding a full environmental review for the Marici battery storage project. I've attached the presentation slides to this email.

I'm not going to sugar-coat my words here: we're in a bad position.

The cost of August's legal fees to fight the City of Industry totaled about $19,000. Our remaining funds from donations are around a few thousand dollars. If we cannot pay our legal fees, then the lawyer will stop working, and the lawsuit ends before it even gets a day in court.

The City of Industry is stalling the lawsuit to bleed our community’s legal fund dry before the case even gets in front of a judge. Every stall action from the City of Industry costs us lots of money.

The community sets our priorities. If there are not enough donations, you are telling us that a full environmental review of the battery storage project is not important to you. PHCPA will have no choice but to listen to the community, give up on the lawsuit and shift focus.

BUT, I BELIEVE IN THE STRENGTH AND SOLIDARITY OF OUR COMMUNITY!

You might be asking, "Is raising this much money even possible?" Yes, it's very possible because we've come this far with only a few people taking actions.

The $38,000+ raised so far has come from just 310 people, with some people donating multiple times.

Over 102,000 people live in just Hacienda Heights and Rowland Heights.

Over 1 million people live in unincorporated LA County, which we are a part of.

There are still so many people that have yet to take an action – we just need your help to find them!

For example, this email reaches 5,000 people. If everyone donated $5 every month, we would have $25,000 each month to fight the City of Industry. Of course, the historical reality is that half the people don't read these emails, and maybe 3 people will make a donation...

What’s preventing you from taking action to support PHCPA? Please email outreach@phcpa.org with your questions and/or concerns, and I will personally address each and every point until you are satisfied that we are a real nonprofit organization, that we are all unpaid volunteers, that our lawyer doesn't want to lose, that even $5 makes a difference.

PHCPA is currently engaged in public interest litigation under the California Environmental Quality Act (CEQA), challenging the adequacy of the environmental review adopted for the 9.2-acre, 400-megawatt Marici Battery Energy Storage System (BESS) project located across the street from Hacienda Heights residents.

We are also working to oppose the proposed AI data center at the Puente Hills Mall.
