No Child Should Lose a Loving Parent Because of Migration Decisions

Every child deserves the love, guidance and support of both parents. No child should lose a loving parent because of immigration decisions that fail to fully consider the long-term impact on families.

My name is Vijay Jindal. In January 2023, I migrated to Australia under a Subclass 491 Skilled Work Regional (Provisional) visa with my wife and young son. Like many migrants, I left behind a successful professional career, financial security, and my extended family in the hope of building a brighter future for my child in Australia.

Since arriving in Australia, I have worked lawfully, paid taxes, complied with all visa conditions, contributed to the community, and actively supported my son's education, sporting activities, and personal development.

Following a family breakdown and subsequent migration complications, my visa was cancelled and my appeal before the Administrative Review Tribunal was unsuccessful. I now face removal from Australia and the heart-breaking prospect of being separated from my son for many years, potentially for the remainder of his childhood.

My son lives in Australia and is at a critical stage of his life. He benefits from the emotional support, encouragement, guidance and financial assistance of both parents. If I am forced to leave Australia, our meaningful parent-child relationship will be severely impacted by distance, financial hardship and international borders.

This petition is not only about my family.

Across Australia, migration decisions can unintentionally separate children from loving and involved parents, even where those parents have lived lawfully, contributed positively to society, complied with Australian laws, and maintained genuine relationships with their children.

Children should not bear the consequences of migration decisions without careful consideration of their emotional wellbeing, educational development and long-term interests.

I respectfully call upon the Australian Government and Parliament to:

• Ensure that the best interests of children are treated as a primary consideration in migration decision-making.

• Require decision-makers to fully assess the long-term impact of parental separation on children before visa cancellation or removal occurs.

• Strengthen protections for parents who maintain genuine and meaningful relationships with children living in Australia.

• Review migration policies that can result in unnecessary family separation.

• Give greater weight to family unity, compassion, humanitarian considerations and child welfare.

• Reconsider my circumstances and allow me to remain in Australia so that I can continue supporting my son emotionally, physically and financially.

Australia has always valued fairness, compassion and the importance of family. Children should not lose a loving parent because of unintended consequences within the migration system.
