The Issue

Dear Honorable Judge Paul R. Bernar:

We, the community of Santa Clara County, friends, and family of Nina Fathizadeh, hereby submit this petition to beg for your mercy and forgiveness. We request leniency regarding her sentencing.

We are aware she is guilty of negligence that caused the death of two infants.  We all understand that Nina admitted her responsibility in this matter.  We know that Nina loved and thought of the deceased children as her own. Since their passing Nina has mourned and cried for them. She has visited the grave of Lillian on numerous occasions, laying flowers and saying prayers for both children, as she has not been able to locate Payton’s burial site. 

We sincerely appreciate your consideration of mercy for Nina, as we hope to prevent her children from experiencing trauma, and consequently a potential lifetime of suffering. We believe this would occur as a result of having their mother incarcerated during their formative years.
