The Issue
To: State Governors, State Legislatures, States Attorneys General, Lyft CEO David Risher and Uber CEO Dara Khosrowshahi and their repective Boards of Directors, U.S. Department of Labor, U.S. Department of Transportation and Other Relevant Stakeholders
Petition Overview
We, the undersigned, demand comprehensive protections and benefits for all rideshare drivers operating as independent contractors for transportation network companies such as Uber, Lyft, Ztrip, and others not listed. We believe these measures are necessary to ensure fair treatment, safety, and economic stability for drivers across the nation. The inspiration for our demands comes from the recent settlements in Massachusetts and others, and we request all drivers be awarded the same consideration.
Proposed Protections and Benefits
1. Guaranteed Minimum Earnings:
Drivers shall earn a minimum of $24.50 per hour for engaged time, which includes time spent on the way to a ride, time spent picking up passengers, and time spent during the ride. This amount may be adjusted for more expensive markets.
Additionally, drivers shall receive a guaranteed minimum earning of $5.00 per hour whenever they are online and available for rides, provided they have no more than 1 declined ride in an hour or 4 declined rides in an 8-hour period. Declined rides due to safety concerns, as determined by GPS and motion sensors, such as driving at "Highway Speeds" as defined as 50MPH or Greater or GPS positioning on a major interstate highway will not count against this acceptance rate.
2. Paid Sick Leave:
Drivers will receive 1 hour of sick pay for every 30 hours of engaged time, up to a maximum of 40 hours of paid sick leave per year.
3. Occupational Accident Insurance:
Transportation network companies must provide occupational accident insurance coverage of up to $1,000,000 at no cost to the drivers.
4. Healthcare Stipend:
Uber and Lyft will provide a health insurance stipend benefit for qualifying drivers who average at least 15 engaged hours per week combined across both platforms. This stipend will be paid as a cash health payment for qualifying health plans on the Marketplace.
5. Paid Family Medical Leave:
Drivers shall receive half the cost of enrolling in the state's Paid Family Medical Leave insurance program at the end of each quarter.
6. Safety Features and Acceptances:
While the vehicle is in motion, drivers will have a longer acceptance window for ride requests, extending it to a minimum of 20 to 25 seconds when auto-accept is not engaged. This is to allow drivers adequate time to assess ride requests safely without compromising their focus on the road.
Passengers must have their IDs and names verified by Uber and Lyft before they are allowed to use the platform. Continuous verification of passengers is necessary to ensure that drivers are picking up verified individuals who have been vetted for safety and maintain a high star rating- 4-5 stars, 3 stars placed on probation for investigation, and 2 or fewer stars removed from the platform after investigation.

Uber and Lyft must provide live chat and phone support to all drivers regardless of tier level.

Desired Effective Date:
