Change the Definition of Rape in Georgia
The Issue
The definition of rape in Georgia is outdated and flawed. In order to create a safer and more just state, we need to fix this definition. It currently doesn't include: Oral rape Anal rape Male on male rape Female on female rape Rape in which men are raped by women It also includes the word "forcible," which implies that violence or the threat of violence must occur in order for the assault to be considered rape.
This is the current definition of rape in Georgia: “A person commits the offense of rape when he has carnal knowledge of: 1. A female forcibly and against her will; or 2. A female who is less than ten years of age. Carnal knowledge in rape occurs when there is any penetration of the female sex organ by the male sex organ. The fact that the person allegedly raped is the wife of the defendant shall not be a defense to a charge of rape.”
An example of a more progressive and comprehensive definition of rape is the FBI's current definition: "Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim."
