Dear Animal Lovers, 

In the light of many many animal cruelty cases being reported and handled everyday by many of us, we are creating this petition which is also a letter drafted to higher authorities on behalf of all Animal Welfare Organizations, HAWO’S and Animal Welfare Activists. 

As there are many cases of dogs and other animals being mercilessly attacked, abused and killed across our country, we are running this campaign to take maximum signatures to demand stricter laws, harsher punishment against animal cruelty and also amendment of the Cruelty to Animals Act, 1960.  

The Prevention of Cruelty to Animals Act, 1960 needs to be amended to provide #JusticeForAnimals - we need immediate attention and action on this. There's a need for #StricterLawsAgainstAnimalCruelty". 

What is lacking? 

Animal Welfare Board of India has issued letter dated 28. 10. 2015 to the Director General of Police of States and Union Territories and interalia requested to do the following viz.

i)             Issue orders to all the Police Personnel in their States/Union Territories to enforce the animal protection laws effectively so that such enforcements become a deterrent to the infliction of cruelty on the hapless animals;

ii)           Take action to provide appropriate administrative set up in the Department to deal with animal cruelty cases;

iii)          Take appropriate action on the information provided by HAWOs of Animal Welfare Board of India or any complaints brought to the notice by the citizens;

iv)          Bring about awareness about animal welfare laws to the law enforcement personnel at all levels as envisaged by the Ministry of Home Affairs direction to include the animal welfare protection laws in the curriculum of the Police Academy; and sought their co-operation,

we note that, the said request has not been complied with at all till date.

Our Request to Authorities: 

Issue and publish or cause to issue and publish a Circular or GR (Govt. resolution) stating/declaring that cruelty to animals & intimidation and harassment of Pet Owners and Care-givers of Stray Animals/compassionate citizens is a grave and non bailable offence, the perpetrators of such offence shall face stringent action including immediate arrest and directing the police and all other authorities to take immediate strict action against the perpetrators of such offence.

Letter to Authorities: 

Sub.:-   Extreme cruelty to Stray Animals & Criminal intimidation and harassment of Pet Owners and Care-givers of Stray Animals/compassionate citizens.

This petition is on behalf of all Animal welfare Organizations, HAWO’S and animal welfare activists in the State, including those who have signed hereunder, and more specifically Thane SPCA whose key mandate is to propel animal welfare as a mainstream social change movement in India. It is also Thane SPCA’s belief, born from experience across the globe, that the adoption of measures that exacerbate and aggravate human-animal conflict, is grossly detrimental to human interest. The adoption of such measures interferes with the fundamental right of citizens to life and liberty, and is therefore a violation of Article 21 of the Constitution of India.

In keeping with this mandate, I write to you with reference to news articles, social media  post and several complaints (copies enclosed) received by Thane SPCA and other Animal welfare Organizations from Pet Owners and Care-givers of Stray Animals/compassionate citizens on the captioned subject.

As you may be aware, through the press, social media and complaints to Thane SPCA and other Animal welfare Organizations, several incidents interalia of extreme cruelty to Stray Animals under the pretext of menace and nuisance have been reported, the recent one’s being  Bindu dog rape case, worli case of Lucky, Naigaon case of drowning of stray into the nalla, beating the stray near Powai, posh gated community by security guard on so called instructions by the members sitting in their own houses and instructing this cruel act, the culprits who did the gruesome crime are still roaming free on the roads. We, the animal lovers cannot witness and tolerate such extreme cruelty to voiceless animals. We would request you to take immediate action as requested below to stop this cruelty which is uncalled for.

Further, I would inform you that, since May, 2014 Thane SPCA has been, vide its several letters marked to all concerned authorities, repeatedly bringing to the notice of all concerned authorities, including you since 2017, cruelty to Stray Animals & the intimidation and harassment of Pet Owners and Care-givers of Stray Animals/compassionate citizens in housing societies and public places all over Mumbai, Thane and Navi Mumbai for keeping Pets and tending to Stray Animals, but unfortunately, it appears that they have been ignored as a frivolous and minor issue, with the result same continues unabated and citizens rights and liberties are curtailed.

Kindly note Pet Owners, both owners and tenants, are directed to get rid of their Pets and Care-givers of Stray Animals are directed to stop tending to Stray Animals. Law abiding Citizens who refuse to adhere to the said directions are mobbed, assaulted, evicted from their residences, directed to abandon their Pets, imposed hefty fines and penalties, denied NOC for Passports and transfer of flats etc.  Further Stray Animals like Dogs and Cats are poisoned, burnt, beaten brutally, driven over deliberately and maimed and killed and driven out of their territories on the pretext of nuisance by the highly qualified, resourceful and literate masses living in posh and high end Societies.

Although, the Supreme Court of India has vide Judgment and Order dated May 07, 2014 of the Supreme Court of India in Animal Welfare Board of India v/s A. Nagaraja & Ors. Civil Appeal No. 5387 of 2014 interalia declared that animals have 5 freedoms and directed the Animal Welfare Board of India and Governments to ensure that their rights and welfare are protected and the Animal Welfare Board of India has in compliance of the said Judgment and Order issued letter dated 28. 10. 2018 to the Director General of Police of States and Union Territories and interalia requested to do the following viz.

In fact, we find that animal welfare activists and HAWO and their family members are falsely implicated in offences such as molestation, kidnapping etc. and Chapter Cases to curb their legitimate selfless activities and harassed. Even Govt. servants, Policemen and their family members have been targeted. Further applications are filed by the Police in Courts to close genuine FIRs and charge sheets in false cases.

 

Although Art. 48A and Art. 51A(g) of the Constitution casts a duty upon the State and its Citizens to interalia protect animals. the aforesaid will show that the State and its Citizens are acting to the contrary. 

 

I would therefore, on behalf of all Animal welfare Organizations, HAWOs and animal welfare activists in the State, including those who have signed hereunder, and more specifically Thane SPCA, request you to forthwith issue and publish or cause to issue and publish a Circular or GR (Govt. resolution) stating/declaring that cruelty to animals & intimidation and harassment of Pet Owners and Care-givers of Stray Animals/compassionate citizens is a grave and non bailable offence, the perpetrators of such offence shall face stringent action including immediate arrest and directing the police and all other authorities to take immediate strict action against the perpetrators of such offence.
