Under FAA's NextGen, Flight paths that used to be dispersed higher and over a wider area are being redirected lower and in a more concentrated path. In order to save fuel for airline industry, the FAA has forced all aircrafts into a few narrow corridors, shrinking flight paths from miles wide to a mere couple of thousand feet wide with frequent flights at much much lower altitudes. These paths and flying procedures are not in keeping with NextGen goals and have resulted in increasing fuel usage (according to the FAA), dramatic noise impacts, and a huge outcry from millions of the Americans living underneath these flight paths.

In a nutshell, NextGen has been FAA’s Carte Blanche to dismantle and discard decades-old noise mitigation agreements, across all airports in US:

Low flying planes are being sent all over densely populated residential neighborhoods, from NW Las Vegas, all the way to SW Las Vegas. The dangerous activities of General Aviation (mostly related to recreational pilots, touring businesses and flight schools) have grown exponentially out of North Las Vegas airport. They are “acoustically dive bombing” residential Summerlin and all other neighborhoods west of KVGT, early mornings, late at nights and throughout the day, even in 115 degrees, posing  a serious fire and safety hazard.

Many of these planes have had recent history of fatal crashes and major safety concerns. Banned or dismissed in other places like Sky Combat Ace, many of these planes have found a refuge in KVGT and have been “aviation bullying” residents with flybys, dives, low altitude and dangerous maneuvers, sometimes blatantly below Federal regulations. 

More than 11 million Americans across the country (from Bay Area California, to Washington DC, Boston, Charlotte, Chicago, New York, San Diego, Seattle, and Las Vegas) have found themselves the victims of non-stop aerial assault and constant noise pollution imposed on them by FAA’s NextGen. Communities that once experienced 10-20 flights overhead daily now found themselves subject to 200-300 flights a day overhead, at elevations thousands of feet lower than previous flightpaths.

The FAA’s unrestricted airspace (over densely populated residential homes), concentrated flights paths at KVGT with elevations thousands of feet lower than before and lack of any noise ordinances or regulations have opened up doors to “aviation lawlessness”. Under FAA’s benevolence,  these recreational pilots can exploit a highly subsidized activity and continue to subject residents below to frequent and low dangerous maneuvers, aviation bullying and other forms of pilot aggression that would put one under arrest in a non-aviation world for harassment, abuse and stalking. 

As a result of creating a safe haven for recreational pilots with history of illegal substance abuse, fatal crashes, and major safety concerns, these recreational pilots have continued to abuse and harass residents below without any consequences, reprimands or having to face prosecution. Worse, more and more recreational pilots have become emboldened by FAA's laziness to “aviation bully” homes of local activists who are being targeted daily with fly-bys, dives, low-altitude maneuvers, and other forms of pilot aggression. Under ADS-B Privacy, a growing number of GA abusive pilots act like high school bullies, regularly turning off their transponders from public while they are on "full aerial assault".

Many residents have expressed inability to concentrate, work, or focus, their children to able to sleep, and suffer from sleep deprivation, high blood pressure, hypertension, stress, depression and anxiety caused by planes flying lower and more often. There is an avalanche of studies, a dozen studies conducted by the FAA itself that the negative health and psychological impacts of aircraft noise and lead-based fuel pollution at low altitude can literally decimate a population over time, especially in vulnerable communities that include children, newborns, seniors, pregnant women, restaurants, club houses, schools, etc. No amount of lead is safe for children. 

Despite the huge outcry from the American public, the FAA has continued to muffle any opposition by citing benefits of saving time, cost and fuel for airlines and expanding General Aviation, under excuse of needing more pilots and citing “pilot shortages”:

That would be laughable if Las Vegas didn’t have so much open space where these low flying “light weight” planes could easily take off and land, even on standard paved road (and they don’t weight anything near a Saab Gripen – more like 5%, but they think they are). They don’t need to be in a major airport in middle of the City, joyriding on top of densely populated residential neighborhood, torturing residents with low altitude maneuvers/noise pollution and poisoning them with lead-based fuels. We have neighbors who’ve lived here for the past 30 years and never experienced such noise and fuel pollution or belligerent foul-mouthed pilots who bully residents who call them to complain.

Many touring businesses like Sky Combat Ace who have been feeding a bunch of “adrenaline junkies” with thrill rides and other stunt activities have taken advantage of loopholes and register their “touring business” under “flight school” to avoid oversight in terms of maintenance and pilot training.  Sky Combat Ace has been exploiting the FAA's loopholes to be able to operate almost in a regulatory vacuum, with little or no oversight.

The FAA’s laziness has literally emboldened these recreational pilots to continue to subjugate residents below to constant noise, lead-based fuel pollution, abuse, harassment, loud decibels that even exceeds FAA’s own noise limit and frequent and dangerous maneuvers, 7 days a week, 24/7. 

The FAA’s computer modeling that NextGen would create “no new noise” and impose no significant changes was demonstrably false, as evidenced by the thousands upon thousands of new noise and air pollution complaints being lodged across the country. The computer modeling uses many flawed data assumptions that are heavily skewed to the benefit of the FAA – including an allowance for an “average” of 65 decibels (vs the 55 decibel norm more commonly  used by other countries when modeling airplane noise). Allowing for an “average” of 65 decibels means that hundreds of planes flying these concentrated NextGen routes can be far louder than 65 decibels as long as the “average” is 65 decibels. When the FAA says that NextGen sufferers are “only” being subjected to a constant stream of noise at 65 decibels – they’re leaving out the part about that being the average. Many cities across US have found out that taking legal action against the FAA maybe the only chance to provide their residents with a more homey and safe environment, without General Aviation harassment and abuse or what some residents call “domestic terrorism”:

After spending many hours at the FAA workshops and many community leaders working with the FAA directly to get some relief for their residents, many municipalities were in for a rude awakening. That the FAA has showed absolutely no interest to offer any relief to NextGen (although it’s a failed system) and is expanding general aviation dangerous activities without any consideration for the residents. 

For many municipalities (like Burien, Washington, Phoenix, Arizona, or LA, California – which successfully have sued the FAA and WON) going to court maybe the only option to protect their residents and their integrity of life from FAA’s nextGen or General Aviation harassment and abuse:

The FAA’s job has become to exponentially expand general aviation and protect airline industry’s bottom line, at a great cost to millions of law abiding taxpaying American citizens who pay expensive mortgages and property tax and feel harassed, terrorized and are made feel unsafe inside their own homes.  

To be fair to City of Las Vegas, the City took the FAA to court back in Feb. 2021 but the lost the battle over FAA’s NextGen right turn that sends majority of Harry Reid traffic over densely populated residential neighborhoods west of the airport.  The judge ruled in favor of the FAA (maybe the City didn’t hire experienced attorneys or the judge couldn’t comprehend this important issue), but the devastation of FAA’s NextGen can clearly be seen today all across the valley. From constant noise to lead based fuel pollution (over the same communities, at low elevations, hundreds of times per day), the airline industry and wrath of General aviation is turning some of Las Vegas most affluent residential neighborhoods like Summerlin into a ghetto. Some of these planes are decades old and emit toxic pollutants like carbon, PM2.5, and lead over vulnerable communities over and over.

  • Phoenix won the case against the FAA:  The US. Court Of Appeals For The District Of Columbia Finds For The City Of Phoenix In City of Phoenix vs. FAA Requiring FAA To Revert to Pre-NextGen Flightpaths. Among other findings, the Court found that “by keeping the public in the dark, the agency (FAA) made it impossible for the public to submit views on the project’s potential effects – views that the FAA is required to consider.” - The City of Phoenix was luckier and maybe a bit smarter than other cities – in filing their lawsuit quickly, they were able to avoid a statute of limitations standard for filing cases against a federal regulatory agency (even though, technically, they did miss the statute of limitations). In contrast, other communities choose to work with the FAA in good faith to help alleviate the problems caused by NextGen in the belief that the FAA genuinely wanted to work with them. Instead, the FAA promised to “engage” in community roundtables and “work towards” a solution that would alleviate the unbelievable air and noise pollution caused by NextGen. Every day, Hundreds of low flying commercial planes and recreational planes (helicopters, Cessna, single props banned or dismissed in other places because of fatal crashes) are being sent over densely populated residential neighborhoods, even those far away from the airports. If there is ever a crash, these planes, depending on their size, can take out a few homes or a few blocks all together. 

The FAA’s NextGen favors the City of Henderson, by increasing noise and fuel pollution for the City of Las Vegas and some of its most affluent residential neighborhoods “ Summerlin”. No community, affluent or not deserves to experience such pollution brought upon them by General Aviation or airlines industry: 

For the past 8 months, there is little to no traffic over the affluent parts of Henderson (green valley, or even Anthem). Both Green Valley and Anthem are much closer to Harry Reid and Henderson Executive, yet they don’t have even a fraction of the traffic Summerlin communities are experiencing because of KVGT or Harry Reid.  

Commercial planes are flying much higher over Green Valley, Henderson, while they are flying much low over residential summerlin (although Summerlin is further away from major airports and has much higher elevation). Even self serving General Aviation pilots like Vegas aviation, tactical integrated training solution and Chennault flying services, or others seem to be flying 8000 ft or higher over green valley Henderson (if they even fly there occasionally), while they terrorize Summerlin residents with low flying offensive maneuvers and aggressive war-like flying behavior, some even below Federal regulations of a 1000 ft, as early as 5 am and as late as 2 am.  Many flight schools like All In Aviation of Henderson are now routinely practicing over Summerlin communities around lakes, golf courses and parks. 

Despite major safety concerns, Sky Combat Ace was dumped from Henderson to Summerlin:   

Kicked out of Henderson, NV and BANNED in Oceanside, CA (because of multiple FATAL crashes and major safety concerns), Sky Combat Ace is regularly targeting Sun City and Summerlin because of the view of the golf courses. They are destroying peace and tranquility of your neighborhood while endangering the life and safety of the residents. Henderson junk planes with history of fatal crashes and safety concerns have been dumped in Summerlin. In a few years, Henderson home prices will skyrocket while devaluing Summerlin home prices. 

They are gambling with your life by dangerously maneuvering and joyriding on top of your homes, even in excessive heat or thunderstorms. Sky Combat Ace E300s are routinely harassing SCS, Summerlin communities around golf courses and NW residents: N247MA and N6855S (as early as 7 am), N466MD, N69XT, N269KD, N21XT, and N763DT.
