The Issue

Holding Permanently Banned Social Media Users Accountable for Ban Evasion and Harmful Online Conduct
Social media platforms have become a central part of modern communication, entertainment, and public interaction. While these platforms provide opportunities for creativity and connection, they have also become environments where harmful behavior can repeatedly occur without meaningful accountability.

Monroe’s Bill proposes stronger protections for online communities by addressing individuals who have been permanently banned from social media platforms for severe violations such as indecent exposure, targeted harassment, cyberbullying, exploitation, or the distribution of explicit content, and who knowingly evade those bans through the creation of fraudulent or alternate accounts.

Current platform enforcement systems often fail because permanently banned users are able to return within hours using fake names, burner emails, VPN services, or duplicate accounts. This repeated cycle undermines platform safety policies and places users — especially minors and vulnerable individuals — at continued risk of harassment, exposure to inappropriate material, and targeted abuse.

Monroe’s Bill proposes the following measures:

• Individuals permanently removed from a social media platform for serious violations involving nudity, indecent exposure, exploitation, or documented harmful behavior who intentionally create fraudulent replacement accounts may face civil penalties and escalating fines.

• Repeated ban evasion involving continued harassment, exploitation, stalking, threats, or the redistribution of prohibited content may qualify for criminal review under applicable state or federal law.

• Social media companies would be encouraged to cooperate with lawful investigations involving repeat offenders who intentionally circumvent permanent safety bans.

• Platforms would retain discretion regarding moderation decisions while being granted clearer legal pathways for addressing organized ban evasion tied to harmful conduct.

This proposal is not intended to suppress free speech or lawful expression. Instead, Monroe’s Bill is designed to strengthen accountability for individuals who repeatedly violate platform safety rules and intentionally bypass enforcement systems after serious misconduct findings.

Online safety should not end when a platform issues a permanent ban. If an individual has demonstrated repeated harmful conduct severe enough to warrant permanent removal, there must be meaningful consequences for knowingly returning under fraudulent identities to continue the same behavior.
