The Issue

In Hawaii, the requirement for notaries to keep a strictly paper-based notary record journal is an outdated law that affects thousands of notaries public and hundreds of thousands of residents and businesses across the state. Like many notaries, I struggle with the inefficiencies and practical limitations of paper records. This policy doesn't just make our jobs harder; it also impacts the people of Hawaii who rely on our services.

In an age where technology has streamlined and secured most facets of professional life, clinging to paper-only notary journals is no longer tenable. This antiquated requirement leads to increased costs, manual errors, less efficiency, makes it more difficult to store and retrieve records when needed, and is ultimately less secure and safe than electronic notary journals. With electronic notary record journals, we can enhance the security, accuracy, and efficiency of our record-keeping processes as well as reduce storage costs and space. 

Electronic record-keeping would not only secure the integrity of notarial acts and the privacy of the signers but also serve the public more effectively by providing faster and more reliable service. For instance, digital records with encrypted security measures can significantly reduce the risk of fraud, loss, or damage that is inherent with paper records.

Furthermore, the recent COVID-19 pandemic demonstrated the undeniable need for digital capabilities in essential services, notarial services included. Many states, such as California and Texas, have already set the precedent for allowing electronic notary record journals for tangible documents. It is time Hawaii follows suit and enters the digital age.

To ensure Hawaii notaries public can better serve the community, and to uphold the state's commitment to innovation and efficiency, we urge the legislative body of Hawaii to amend the current laws and regulations to permit the use of electronic notary record journals for tangible documents.
