Misled by David Eby’s Government: ICBC’s No-Fault System Harms the Innocent and Strips Away Their Rights. Demand David Eby’s Resignation.

The Insurance Corporation of British Columbia's (ICBC) Enhanced Care model, purportedly designed to provide more affordable auto insurance and better support accident victims, has been met with widespread criticism, operational failures, and a multitude of harms to the very citizens it was meant to protect.

Premier David Eby, as leader of the NDP government, has overseen the implementation of this model during his tenure, which has failed to deliver on its promises and caused serious harm to injured British Columbians and their loved ones.

We, the undersigned, demand the immediate resignation of David Eby and the NDP to restore democratic accountability after the BC government’s roll-out of ICBC’s Enhanced Care system — a system that has caused widespread failures and harms to injured British Columbians by stripping away fundamental legal rights and protections.

 
The Enhanced Care model fundamentally alters the rights of British Columbians by:

  • Stripping away the right to sue at-fault drivers for most personal injuries—including compensation for pain and suffering—leaves injured British Columbians without the means to recover for the physical, emotional, and financial impacts on their lives.

 

  • Removing the right to seek compensation for pain and suffering, denying victims fair recognition for their trauma.

 

  • Eliminating the right to sue ICBC itself, leaving injured people with no legal recourse against the insure.

 

  • Removing meaningful legal oversight from ICBC claims and care process.

 

  • Eliminating access to funded legal representation for those unable to afford private counsel.

 

  • Removing access to funded independent medical care from unbiased healthcare providers—not attached to or influenced by ICBC—unless claimants can afford to pay privately.

 

  • Shifting the burden of proof, medical navigation, and claims disputes entirely onto injured individuals.

 

These are not minor administrative changes. They are substantive restrictions on access to justice, which directly impact the Charter rights of injured individuals under Section 7 (life, liberty, and security of the person) and Section 15 (equality under the law).

If the electorate was not fully and clearly informed of these outcomes prior to the last election—whether through omission, misrepresentation, or suppression of material facts—then the democratic process was compromised.

In a free and democratic society, major reforms that remove access to courts and legal recourse require the informed consent of the governed. That consent was not freely given if the truth was withheld or obscured.

 
Therefore, we call for:

  • A public inquiry into the development, disclosure, and implementation of ICBC’s Enhanced Care legislation.

 

  • The immediate restoration of full legal rights for injured persons, including the right to sue negligent drivers and ICBC, the right to seek compensation for pain and suffering, and to access independent legal representation.

 

  • Guaranteed access to independent healthcare providers and medical assessments free from ICBC influence or bias—so injured individuals can receive unbiased, patient-centered care and fair evaluations.

 

  • A provincial early election, on the grounds that the public was not adequately informed of the legal implications of this policy during the last election cycle, violating the principles of transparency, consent, and democratic legitimacy.
  • The immediate resignation of David Eby for overseeing a system that violates the trust and fundamental rights of British Columbians.
     

Democracy demands accountability. When government conceals or distorts the truth about legislation that removes fundamental legal rights, it forfeits the trust and consent of the people. An early election is not only justified — it is necessary.
