Minor constitutional rectifications

The Issue

I hope this finds you well. I am humbly requesting minor constitutional rectifications mentioned below. 

I accept that, as a 12th-pass student, I may not be as experienced or knowledgeable as the government, which comprises seasoned bureaucrats and politicians. However, I respectfully request that you consider and plan to implement the following minor suggestions. 

(01) Firstly, I propose the creation of a constitutional body, namely the Sanatan Aayog, to oversee the management, maintenance, and implementation of proper standards for offertory (bhog/prasad) and queue management for devotees. This body would replace the Hindu Religious and Charitable Endowments Department of the states, which currently controls Hindu places of worship, often run by bureaucrats lacking attachment to or knowledge of the deity and temple practices. 

The relationship between the deity and its caretaker is akin to that of a mother and child, making third-party intervention unnecessary. Establishing the Sanatan Aayog would prevent incidents like the stampede and adulteration that occurred in 2024 and provide certification for Satvik Bhojan. This ensures devotees like myself have access to suitable foodstuffs during fasting periods. 

The Aayog would comprise mahants or members of recognized akhadas, nominated by the mahant of the respective akhadas, as well as shankaracharyas from all four maths, with no political affiliation.

Don't you agree, Sir/Ma'am, that this is a reasonable request, especially considering the existence of Waqf boards and Halal certification for foodstuffs in our secular country? 

 

(02) Secondly, I strongly believe that problems are better solved through electoral politics instead of bureaucratic red-tapism. To achieve this, I recommend replacing the colonial era District Collector or Magistrate with an elected government, granting them proper powers and financial freedom. Furthermore, local bodies like district governments and rural local bodies should be removed from the state list and recognized as a separate tier of government. This would revive the thousands of years of existence of local self-governments. Every state should have a bicameral legislature with the upper house representing the districts. I don't support the idea that state governments want a more powerful Rajya Sabha while restricting the powers and representation of local governments. 

 

(03) Thirdly, I believe that, based on what I have seen and read about paper leaks and result delays, there should be a single independent commission at various tiers of government (federal, provincial, and local) to oversee the appointment of all bureaucrats, regardless of group (A, B, C, D, etc.). This commission would ensure a standardized process for examinations and post-examination appointment procedures. Delays in exams take a heavy toll on the physical and mental health of aspirants. As a government job aspirant myself, I speak from personal experience. 

The commission would comprise members appointed by a committee consisting of government representatives, independent elected legislators, and one legislator from each party. Although I have complete faith in the government that it is doing its best for the public, I am proposing these rectifications for transparency and to debunk accusations of controlling institutions by the government and lacking diverse views as happened in the case of the high level committee on one nation one election where many critics accused central government of appointing majority of members related to BJP. I propose that this commission be responsible for appointing bureaucrats to all judicial, public service, and government enterprises, thereby ending the colonial-era system of separate appointments that has allowed nepotism and favoritism to plague the judiciary. 

 

(04) Before reading my fourth proposal, I suggest you consider the following:  

(I) Many newspapers and online news outlets published the news of a tribal woman who was forced to clean the hospital bed by some upper caste doctor and nurses on 2nd November 2024 which was later proven false as the doctors and nurses weren't from upper castes and the women did it on her own but the medical staff faced suspension because of false news peddling. 

(II) Many people, including Mr. Munish Dalal (2003), Mr. Gunasekharan Dharmaraja, Mr. Sarvjeet Singh (2015), and the medical staff mentioned above, have had their careers or lives destroyed or are facing mental harassment or ostracization by society due to false news and the negligence of mainstream broadcast media and social media. That's why I prefer and trust alternate perspective media like the Jaipur Dialogues or OpIndia, as they follow more journalistic ethics than the so-called journalists and news outlets themselves. These outlets often shout slogans like "sach dikhate hain hum, taki mehangai ke bazaar me azaadi sasti na bik jaye.” 

(III) The current exam curriculum for government departments and enterprises needs a major overhaul. It's absurd to include current affairs and history questions in clerical job exams, especially when they're not relevant to the job requirements. Moreover, the history being taught in NCERTs and competitive exam books is inaccurate, focusing on debunked theories like the Aryan Invasion Theory. These books not only misinform students but also overlook the contributions of notable figures like Bappa Rawalji, Lachit Borphukanji, and Jhalkaribaiji. 

Therefore, my fourth proposal is to create constitutional bodies, namely Central and State Education and Information Commissions, as education and information are interlinked. The mainstream broadcast media has a huge influence and shapes public opinion. Consequently, it becomes extremely essential to check the influence of anti-Bharat and sinister minds and prevent the unchecked growth of media. The commission would label books, social media handles, TV news channels, and universities as anarchist, libertarian, Marxist, or unbiased and give them rankings based on their accurate information or political neutrality for national, state and district levels, similar to how the National Institutional Ranking Framework (NIRF) ranks educational institutions nationally. This will make people more aware of which of these are genuine and which ones are ideological or foreign-funded (mainly China and Europe) mouthpieces or ideological training grounds. 

The commission would comprise members appointed by a committee consisting of government representatives, independent elected legislators, and one legislator from each party. Although I have complete faith in the government's ability to act in the public's best interest, I am proposing these rectifications to ensure transparency and address accusations of government control over institutions and lack of diverse views. This concern is highlighted by the case of the high-level committee on "One Nation, One Election," where critics accused the central government of appointing a majority of members affiliated with the BJP. 

 

(05) Fifthly, I recommend scrapping bodies and authorities like the Comptroller and Auditor General, Lokpal, Lokayukta, and Vigilance Commission. These institutions were either created by colonial rulers for their own purposes or established as tokenistic measures by previous governments to pacify the public. However, they ultimately failed to check corruption, as they either lacked the power to appoint proper staff or had restricted powers and funds. Abolishing these bodies will save a significant amount of funds, which could be utilized to appoint more judges and support development projects.

 

Before reading my final proposal, I suggest you consider the following:

(I) The collegium investigated a judge for his c*tmulla remark but took no action on the judge who laughed at a man’s pleas of harassment and mental torture by his wife. The man later committed suicide because of this injustice which will deter men from filing similar cases in future. 

(II) Although, the judiciary has acknowledged that the majority of dowry harassment and domestic violence cases by women are false but still harasses men while applying the maxim principle of volenti non fit injuria in the opposite scenario. 

(III) In contrast, the judiciary takes 30-40 years to adjudicate cases involving common citizens, who are often imprisoned for minor offenses and forced to endure subhuman conditions, sometimes without being proven guilty. Meanwhile, politicians facing serious charges receive preferential treatment, including massages, quality food, healthcare, bail, and timely court hearings. 

(IV) The judiciary seems to focus on preaching to and forcing one community to end child marriages (a stance I agree with), but when asked to abolish the practice across all religions, they divert attention to childhood betrothal or some other topic. Moreover, they remain silent on non-marital coital relationships among minors normalised by films and web series, which have adverse effects on their career, education, and health. It seems that the Bhartiya Nyaypalika is funded by European and North American organizations rather than Bharat's consolidated fund. 

(V) The judiciary grants timely bails and paroles to so-called journalists biased towards the BJP and its policies, but denies even slight relief to genuine critics and social activists. These individuals raise their voices against adulteration and misleading food product advertisements by big companies, which silence them by filing lawsuits in different regions across the country under SLAPP (Strategic Litigation Against Public Participation). 

Therefore, my final proposal is to implement the third and fourth proposals as soon as possible. This would enable the funds currently wasted on the aforementioned bodies to be utilized in establishing Supreme Court benches in every state capital and High Courts in each district of the state, thereby expediting the adjudication process. Furthermore, I propose that a law be enacted to simplify the process of filing cases and appearing in hearings. This would prevent individuals raising awareness from being harassed by having to travel hundreds of miles from their workplace or residence for a single hearing. 

I would appreciate it if you could consider these proposals and take necessary steps to implement them.
