Stop Indian IT companies from forcefully holding employees with 3 months' notice period

The Issue

NOTICE PERIOD

USA, UK, Australia, Singapore, Sri Lanka, China, Europe, Canada:

Ranges from 1 day to a maximum of 4 weeks notice which is further flexible and no employee can be forced to stay and work.

India: 90 days, and furthermore non-negotiable

 

Almost all IT firms in India have made a mandate for their employees to serve a notice period of 90 days which is non-negotiable most of the times. People who have resigned and don't want to continue in a particular company for whatever reason have no choice but to stay and work for a period of 3 months which if not complied with, might lead to getting blacklisted forever with that company or loosing experience proof letter for their employment.

No role/task is such that which cannot be officially transitioned to next person/team within a month. I have personally given both major and minor transitions on switching assignments and it always took me from 3 days to a maximum of 15 days to do it.

There is no valid reason to force someone to work for 3 more months when they have to discontinue working for personal reasons. Most of the times those 3 months become unbearable as employee may not be treated very well because of his/her resignation.

Also, it is unrealistic for anyone to plan that far ahead for their future actions and resign in advance not knowing state of the issue in next 3 months while failing to give immediate attention to problem at hand.

I believe IT has been every growing job sector for India but I am not sure if their policies have been evaluated by Indian Ministry of Labor and Employment so I want this to be brought to their notice. Please sign if you agree with the cause.
