The Middletown Planning Board Meeting – August 6th Update
The Middletown Planning Board convened on August 6th for the fourth time to consider the dangerous and toxic proposal by Fairview Cemetery to build a dual-chamber crematorium along Oak Hill Road. The meeting opened with public comments, and every speaker passionately voiced their opposition to the crematorium.
Concerns raised during this segment included air pollution, mercury emissions, groundwater contamination, impacts on local wildlife, declining property values, and the psychological toll on our children. One of the most compelling comments came from Casey Bond, who shared the struggles of her young daughter, Henrietta. Born at 24 weeks, Henrietta has ongoing breathing issues. Casey explained that her family would be forced to relocate to protect her daughter’s health if the crematorium were approved. Each speaker received resounding applause from the audience.
Following public comment, the attorneys for both sides delivered their final remarks and closing statements. Then, it was the Planning Board’s turn. After some discussion, a motion was made to deny the application for the crematorium. Another board member seconded the motion. The moment had arrived—time to vote!
With only one abstention, all present members of the Planning Board voted to uphold the motion to deny, including Councilman Kevin Settembrino, who delivered a passionate speech explaining why a crematorium has no place in a residential area.
Victory!
The Planning Board has officially denied Fairview Cemetery’s application to build a dangerous and toxic crematorium in Middletown!
What’s Next?
First—let’s celebrate!
This has been a long and difficult journey, and it would not have been possible without the help and support of so many dedicated members of our community. Thank you to everyone who attended meetings, asked thoughtful questions, spoke out, and supported the efforts of the leadership team. Your involvement made the difference.
Is the Fight Over?
Not yet. We’re not 100% sure what Fairview Cemetery will do next, but we believe they may appeal the Planning Board’s decision to Monmouth County Superior Court. If they do, the legal process could take years to resolve. They may also resubmit a new application—or choose to use the property for gravesites instead.
While the future remains uncertain, the Leadership Team will remain vigilant and continue to monitor any actions by the cemetery. One thing is certain: we will never allow a crematorium to be built in Middletown—especially not near homes, schools, parks, and youth athletic fields.
What About the Legislation?
Currently, S-4008 is in the Senate Budget Committee. It must pass the committee and move to the full Senate floor for a vote before it can reach the Governor’s desk. The Senate is not in session again until November, after the election.
The Leadership Team continues to work with elected officials from both parties to push for progress. Our goal is to get this legislation passed by the end of the year. If not, we’ll have to start the process all over again.
How Can You Help?
Please consider donating to our legal defense fund.
Our legal team and environmental expert played a critical role in this victory. Mr. Cohen delivered compelling testimony on the environmental risks of the crematorium, and Mr. Lieberman conducted the hearing with the highest level of professionalism—especially during closing arguments.
We still have financial obligations to meet, and your donations will help us cover these costs.
